Judge isn't named in the Sheriff's press release, but the bail seems pretty low. But doesn't the DAs office weigh in on the amount of the bail/bond?


Sheriff: Waterloo man choked, threatened to kill female during violent incident

A Waterloo man was arrested on multiple felony charges after a violent domestic incident on Tuesday, according to Seneca County Sheriff Tim Luce.

On Tuesday at about 10:32 am investigators arrested Emerson J. Tohafjian, 48, of Waterloo on charges related to that violent incident, which happened in the Town of Fayette.

During the incident, it is alleged that Tohafjian repeatedly choked a female victim, threatened to kill her numerous times, and forcibly raped her. In addition, investigators say he caused injury to a cat by throwing a cat carrier with the animal inside.

Both the female victim and cat suffered minor injuries.

As a result of the investigation, Tohafjian was charged with the following:

– Rape in the First Degree, a Class B Felony;
– Unlawful Imprisonment in the First Degree, a Class E Felony;
– Criminal Obstruction of Breathing or Blood Circulation, a Class A Misdemeanor; and
– Cruelty to Animals, a Class A Misdemeanor.

Tohafjian was arraigned in the Fayette Town Court and remanded to the Seneca County Correctional Facility on $10,000 cash bail or $20,000 secured bond. He is scheduled to reappear in the Fayette Town Court at a later date.

An Order of Protection was issued on behalf of the victim, according to investigators.

Sheriff’s Investigators were assisted by the Sheriff’s Office Road Patrol Division, New York State Police, and the Waterloo Police Department.

Deputies say a 48-year-old Romulus man was arrested on assault charges following a domestic incident that took place on June 3rd.

Emerson J. Tohafjian, 48, was charged with third-degree assault, criminal obstruction of breathing, second-degree menacing, and fourth-degree criminal mischief following the investigation of a domestic incident.

He was arraigned in Fayette Town Court and remanded to the Seneca County Correctional Facility in lieu of $500 cash bail.

An order of protection was issued on behalf of the victim. The charges will be answered at a later date in Varick Town Court.

Apparently, he could not double the bail, as the DA requested, but he certainly could have issued the bench warrant.

Bet he feels like an accomplice. Maybe a lot of people do.

It's actually conservatives who typically defend child molesters, rapists, and women abusers.
