I received an interesting letter from the IRS today, accompanied by a couple of blank forms. They were concerned because they noticed that I have two children and yet did not claim a child-care tax credit on my return. They asked me to fill out the forms and send them back, and they promised that they would send me a check and this and that blah blah blah.

Huh? I read everything again carefully, and then again a third time. There was no problem with my tax return; I am not accused of cheating. On the contrary, the IRS thinks that I am cheating myself by not claiming the child-care credit, and they want me to amend my return so they can send me some money -- even though, and they stated this quite clearly, I have paid nothing in. We are not talking about a refund here; we are talking about an out-and-out gift.

I work outside the country, and have done so for a number of years. Accordingly, my earned income --and my wife's-- is excluded from taxation, up to about $85,000 per year each. Our investment income, or that portion of it not sheltered by IRAs, doesn't come up to the threshold where we would have to pay taxes, since we are a family of four and are entitled to all of the standard exemptions and deductions -- including, apparently, the child-care credit. Note that the foreign earned-income exclusion is an exclusion, not an exemption; when we figure everything up, it's as though we never earned any salaries at all. So, we haven't paid income taxes in years.

The child-care credit is, I imagine, intended to give a break to taxpayers who have the expense of raising kids to contend with. That's fair enough, and an honorable gesture. It helps out those "working poor" who are scraping to afford health care for their children and the costs associated with schooling, including school taxes. But I am not a taxpayer, remember? To reiterate, I haven't paid taxes in years - legally. And I am not poor. My children, and those of my thousands of expatriate American colleagues who are in similar situations, get free medical care, free global health insurance, free tuition at international private schools, and even free plane tickets for our annual vacations. We pay no rent, no utilities; even our internet is free. It's all free, free, free. Living as an expat in a wealthy country is like living in a socialist paradise.

But the IRS thinks that I don't have it good enough. They think I should get a "refund" in the form of a child-care credit, even though they have nary a cent of mine to refund. They tell me I am "entitled" to it.

Well, there is legal entitlement, and there is moral entitlement. If the IRS had its hands on my money, I would do whatever I could to get it back. But this money that they want to send me is not mine; it is not mine, and it is not even theirs. It belongs to you, dear reader, if you are a taxpayer. If you are working hard trying to make ends meet, you should know that the IRS wants to share the fruits of your labor with me, while I am salting away a handsome portion of my tax-free earnings, sending my kids to private schools, and enjoying the view from afar. Does that make sense to you?

It doesn't make sense to me. I crumpled up the forms and the letter and threw them away, with the same nonchalance that the government affects when it throws your money away.

In 1993 the IRS sent me a letter stating I owed $2.00.
The letter was 12 pages long to tell me this.
I had figured something incorrectly and owed the $2.00.
I paid the two dollars and sent a letter with the check
stating another government waste etc.. one page would have sufficed..
You never know with our government they do tend to go to extremes.

Imagine the scale on which they do this sort of thing. I have a colleague who, like me, hasn't paid taxes in years, and for the same reasons. He's banking about $25,000 a year. He just received a check from the IRS for $40 for some kind of credit. Not a lot of money, but multiply that by many thousands of people. Now multiply that by the credits and writeoffs that big-buck investors are getting. Our income-tax system looks more and more like an income-redistribution system.
