Your opinion, please. There is an inmate in the State system (played by Tony Danza in the movie) who was sentenced to a term of life with no parole.
He had a heart attack and died. He was revived. He says he served his sentence. Do you agree?

As long as he still has the same social security number he has the same life- therefore his life is not over and sentence not complete.

If his spirit didn't stay on the other side and returned to his earthly body, it is the same spirit in the same body in the same life on earth.

It wouldnt suprise me to see some hot shot lawyer get that sentence overturned based on that...It sad on what courts do as far as lawsuites and criminal matters these days...the way the system works....someone belts you in the mouth....you get up and defend yourself and belt them back....they call the police first..your screwed...you get arrested for assault and cant press countercharges..believe me Ive seen this happen many times...The system is very broken!!!

Good points. I agree with both. Death row inmates should have DNR's in place.

a "life sentence" is only 40 years. Depending ont he man age and how long he served - he may still have time left when his sentence is done

its a sad sick world

If he could be revived, that means that he hadn't died; death is the permanent cessation of all life functions; the end of life, and one can't be revived from it. It WAS a nice try though. And Thena, life without parole is not 40 years.

To be fair, I think that some "lifers" are paroled, but not the ones that are sentenced "without parole".

Like you said, it seems pretty stupid huh? Unfortunately, I find humor in this. Here we have prison overcrowding; expenses on taxpayers to house and build MORE prisons; do the crime/do the time.... So, here is a lifer who dies and is revived! Just seems so ironic. Thus begins the topic of capital punishment - life in prison versus death penalty. Cheesh! Never ends. So the dude dies - oh dear, we can't "let" that happen! Why not? Dead is dead - leave it alone.

Just to add a little info - he was originally sentenced to die because he killed a policeman. NYS did away with the death penalty (this was a while back), so he was changed to Life without parole.

It's actually an interesting legal argument. LOL. Very clever.

I doubt an argument based on your "spirit" would hold up, but I doubt anyone could make a case to get him actually released - it's fairly absurd. This is certainly not the first time an inmate with a life sentence (or a death sentence, for that matter) has been kept alive and kept in prison to complete their sentence. The state keeps people alive just so they can kill them later! That's called "precedent" and it works in favor of the state, in this case.

True, until some ambulance chaser gets hold of it. I can see it now. No DNR order means the institution in custody (NYS prison system) has to do anything humanly possible to revive the prisoner.
NOt saying I agree, but in our litigous society, that's what it has come to.

Like I said it's an incredibly interesting argument, one I wouldn't mind seeing fleshed out a little, for academic purposes. But to reiterate, the reason it will fail (regardless of how it is worded, framed, or argued by the "ambulance chaser") is because the state has consistently provided that prisoners - even those on death row - with medical problems must be treated. And those prisoners - of which, in the history of our penal system is likely more than a few - who have been revived only to remain alive and serve their life sentences or be put to death constitute a precedent, from which most judges (contrary to popular, media-hyped belief) are loathe to break away from when making rulings.

In short, it will never fly because that's the way it's always been done.

I do however disagree with forcing inmates to sign a DNR.

Ok, so I'm gonna tell everyone I choked on a jawbreaker passed out and saw a white light. I was revived, but becasue of the white light I must have died. Now all my debts should be disolved and I should get to start all over. YES! Good bye student loans!
