Schumer urges BIA to reject tribes' trust applications

SYRACUSE, N.Y. (AP) _ A decision this week by the U.S. Supreme Court makes it "entirely inappropriate" for two upstate New York Indian tribes to pursue their pending applications to put their lands into federal trust, U.S. Sen. Charles Schumer said Thursday.

In a letter to James Cason, the associate deputy secretary of the U.S. Department of Interior, Schumer urged the federal Bureau of Indian Affairs to reject the applications made by the Cayuga and Oneida Indian nations of New York.

"This week's action by the Supreme Court sends a loud and clear message to the Bureau of Indian Affairs that they should take a dim view of the Oneida and Cayuga Land in Trust applications...," said the New York Democrat.

The Supreme Court on Monday declined to review an appeals court's 2005 decision to dismiss a land claim by the Cayugas involving 64,000-acres of ancestral lands in Cayuga and Seneca counties. The appeals court ruled that the Cayugas waited too long to pursue their claim. The appeals court also threw out a $247.9 million judgment rendered by a federal district court jury and judge.

The appeals court decision in the Cayuga case relied heavily on last year's Supreme Court ruling against the Oneidas in a tax dispute with the city of Sherrill. In that decision, the high court said too many years had passed for the tribe to claim that its reacquired former reservation lands were again sovereign and tax-exempt.

Schumer said both applications were flawed because they seek to place large amounts of noncontiguous land into trust, thus creating the "checkerboarding" of authority decried by the Supreme Court. Schumer said the BIA should view both applications with "maximum skepticism."

The Oneidas have applied for trust status for 18,000 acres in Madison and Oneida counties, including the tribe's lucrative Turning Stone Casino and Resort in Verona. The Cayugas are seeking to put 125 acres in Cayuga and Seneca counties into trust. Those properties include two combination convenience store/gas stations and two small gambling parlors.

BIA officials did not immediately return phone calls seeking comment.

Dan French, an attorney representing the Cayugas, noted that it was the Supreme Court in the Sherrill case that suggested New York's tribes could seek federal trust status for their lands as an alternative to a civil land claim lawsuit.

NIGC releases draft of casino licensing regulations

Tribes will have to certify every year that their casinos are operating within the law as part of a new rule developed by the National Indian Gaming Commission.

Under the proposal, tribes will have to submit an annual license for each and every Class II or Class III gaming facility they operate. Among other information, tribes must show that each gaming site is located on "Indian lands" as defined by the Indian Gaming Regulatory Act.

"Indian lands" means all land within the boundaries of a reservation, regardless of trust or ownership status of the land. It also means land that is held in trust and over which a tribe exercises sovereign authority.

The majority of the 400-plus casinos in operation today are located on Indian lands. But recent developments have prompted the NIGC to take a closer look at the legality of particular sites due to the way the land was acquired.

"There have been instances when, literally the night before it happened, we were advised the tribe is going to open a facility and we didn't know the answer to questions like, 'Is that really on Indian lands,'" Hogen said earlier this year at a United South and Eastern Tribes conference.

To address the situation, NIGC has launched two initiatives. The first is an Indian lands database that will contain land information on all the 400-plus casino sites.

The second is the proposal released last week. It puts the onus on tribes, as the primary regulators of Indian gaming, to certify the legality of their casino sites, as well as the environmental and public health and safety standards applicable for the sites.

Why is land in trust even being considered? We owe indians nothing. And please don't give me the 1st grade playground law WE WERE HERE FIRST. The Supreme Court ruled we owe them nothing and that's what they deserve.

Her husband (ex-prez) and his administration are the ones that opened up this pandora's box. They allowed the tribes to open casinos.
