Does a homeowner have any recourse if a contractor draws up a quote, both parties (the homeowners and the contractor) signs up the contract for work to be done, and then the contractor will not return calls for two months as to the status of the job? Dozens of messages were left and not one phone call returned. Thanks.

No, I haven't paid anything, but I'm very angry because I've been sitting around, waiting for him to call me, and I could have gotten the job done by someone else. I just can't believe he won't give me the courtesy of a call back. He's done work for us before, so it's not like we don't have some sort of a relationship.

No, I guess I don't know when or if he even plans on starting it. He was supposed to be at our house in mid-August (he told me an exact date he would start). He never showed and has never called. Isn't a signed quote considered a contract? I guess I'm wondering how far to push it.

well I would think that since he hasn't held up his end of the contract..you can void it. Maybe SJ knows...

We never draw up contracts like that.He gives his estimate;when it's accepted,homeowner & him get together on colors,time to start,etc.Unless it's a huge job,we don't even require down payment on materials.

I just want him to do the freaking job! I guess the question is, does that signed quote hold him legally responsible to finish the job?

I am not a professional, but I would think that just holds him to the quote he quoted you, not a contract to do the job. I would call the BBB and find out if he has had other complaints and may be they could answer your question more thoroughly.

I called the BBB but it's pretty useless. You can't get a live person on the phone and you have to punch in a credit card number to file a complaint, and I don't know if I have enough info for a complaint. If anyone else has any advice, I'd appreciate it!

Find a new contractor. Dont tell em about the other guy though cause sometimes they dont want to "step on each others toes" I had huge issues of lateness and false completion dates with our recent move, we had no bathroom for a week because they were late starting and I had to move in when we did. Very annoying, and he was someone we had done business with before. pm me and I'll tell you who not to get...

If you've got a contract with the contractor, I would think you could take him to small claims court, especially if you've paid him for any of his work. Does the contract indicate when the job is to be finished by? You need to make sure you keep accurate records of when you were trying to get in touch with him.

a quote is just that, a quote. the same for an estimate. by signing the quote, you agreed to the price but that doesnt bind you to stay with this contractor. if you havent paid him anything down, then there is no reason to take him to court. just hire someone else then if the original contractor comes back around, you can listen to his excuses then just tell him you got tired of waiting.

I went to the BB website and filed a complaint..i do not remember having to enter a credit card. They responded quickly, as did the company..with an apology!

If you do go to the website, you can file a complaint for free. But I didn't want to do that if he didn't do anything "illegal." I mean, I guess being a jerk about the whole thing isn't illegal. But if abandoning the job is, I would file a complaint. I don't want to jump the gun and give this guy a negative mark if what he's doing isn't illegal. But he's still a jerk.

Orion, I hope this works out for you! Does he have a crew? If you could contact one of them, you may be able to get info on why he's doing this.
Does he have insurance? It's easy to find someone when they do carry it.(track them down)
We carry it;most homeowners ask to see the proof at least for the first job: after that, when we go back, they're satisfied with who is doing the work.Like I said privately,we haven't advertised in over a decade;word of mouth has people willing to wait half a year for us to pull in if they have to.
One thing my hub does not like, is having to "go over" what another contractor started...nothing to do with "stepping on toes", but rather having to fix shoddy work in order to get down to the rest of the job.
