Epstein Case Shows Corruption in the Legal System Runs Deep

Fresh on the heels of the Harvey Weinstein scandal and amidst the #MeToo movement the scandal spawned, the story of financier and sex offender Jeffrey Epstein is in the headlines again.

Epstein is a former hedge fund manager who made billions of dollars on Wall Street in the 1980s and 1990s. He owns six homes across the globe, including one on his own private island in the Caribbean. Epstein is accused of procuring underage girls to perform sexual acts with him and his guests. In fact, Epstein's reputation was so widespread that the private Boeing 727 jet he used to fly guests to and from his residences was known as the "Lolita Express."

In 2008, Epstein was charged by federal prosecutors in Florida with serious crimes involving minors, including transporting or otherwise luring dozens across state lines for prostitution. Epstein was facing a possible life sentence in federal prison, but he received what has been called a "sweetheart plea deal" and served only 13 months of an already lenient 18-month sentence in the Palm Beach County Jail, not a federal prison. Epstein was allowed to leave jail 12 hours a day to go to his office. The deal also included a promise by the FBI not to release any of the results of its investigations or prosecute anyone implicated in those investigations.

Former prosecuting attorney and Atlantic writer Ken White said the terms were "utterly unlike anything else I've seen in 25 years of practicing federal criminal law." He added, "This is not normal; it is astounding."



The Washington Post published a recent article raising serious issues about Epstein's powder-puff treatment. Alexander Acosta, President Trump's secretary of labor, was U.S. attorney for the Southern District of Florida at the time of Epstein's plea agreement with the Justice Department. We are now hearing calls for Acosta's resignation. Much of the pressure stems from a blistering expose of the earlier Epstein case, published by the Miami Herald last November. The author of the Post article, Aaron Blake, cites the Herald story and points out other troublesome aspects of Epstein's earlier plea deal.


Blake writes that around the same time as the story, "the FBI released a document stating that, at the time of the plea deal, investigators were still interviewing witnesses and alleged victims 'from across the United States.' The obvious question from there is: Was it right to cut such a lenient deal when there was apparently much more to be learned and eventually charged?"

Is that question obvious now? In another high-profile case, 2016 presidential candidate and former Secretary of State Hillary Clinton was under investigation by the FBI for mishandling confidential State Department information in an unsecure email server. If Epstein received a "sweetheart" plea deal, Clinton's treatment was even cushier and more controversial: The FBI simply declined to press charges.


In these grimy stories of sexual excess, exploitation, threats and legal manipulation, some names keep popping up -- and they are likely not names you're thinking of.

One such name is attorney David Boies.

Boies, co-founding partner in the high-powered law firm Boies Schiller and Flexner, has deep ties to powerful Democrats. Boies also represented Harvey Weinstein, and he hired Black Cube, an organization run largely by ex-Mossad agents, to tail, find dirt on and intimidate women who were accusing Weinstein of sexual assault.

Another attorney with ties to both the Weinstein and Epstein cases is New York County District Attorney Cyrus Vance. A prosecutor from Vance's office argued in favor of Epstein's petition to have his sex offender status reduced in New York. According to the Miami Herald: "New York Supreme Court Judge Ruth Pickholtz ... denied the petition, expressing astonishment that a New York prosecutor would make such a request on behalf of a serial sex offender accused of molesting so many girls. 'I have to tell you, I'm a little overwhelmed because I have never seen a prosecutor's office do anything like this. I have done so many (sex offender registration hearings) much less troubling than this one where the (prosecutor) would never make a downward argument like this,' she said."


Vance's office also declined to prosecute Harvey Weinstein when Italian model and actress Ambra Battilana Gutierrez filed a complaint of sexual assault against Weinstein in New York in 2015. Not only did a number of Weinstein's attorneys have ties to Vance but Boies (there's that name again) was revealed to made tens of thousands of dollars in contributions to Vance's political campaigns over the years.

The Epstein and Weinstein cases only confirm what many have suspected for years: Corruption and cronyism run deep in law as well as in politics; many of the players are the same; and ordinary citizens don't stand a chance.

Obama Scandal: Former President Obama and his political supporters have repeatedly stated that his administration was scandal-free, unlike administrations before and after. "We're probably the first administration in modern history that hasn't had a major scandal in the White House," Obama himself said. A new book puts the lie to that statement.

Never mind that the left-leaning big media basically ignored major scandals during the Obama years, ranging from the IRS targeting scandal and the VA's deadly waiting lists for veterans to Hillary Clinton's illegal use of an unsecured, hackable home-brew server for her official duties as secretary of state and the Fast and Furious gunwalking program.

These and others were epic scandals that the media simply ignored or downplayed.

The media have contrasted Obama's supposed honesty and forthrightness with President Trump's supposed venality and political unscrupulousness, as embodied in the year-and-a-half long Russia-Trump scandal investigation that shows few signs of letting up.

But now comes Peter Schweizer's new book, "Secret Empires: How Our Politicians Hide Corruption and Enrich Their Families and Friends," which shows that the Obama administration and its cronies were up to their necks in questionable business deals and may even have intentionally distorted public policy to accommodate their own profit-making.

The book claims "Obama and his administration would deem industries either destructive to the environment or exploitative for the financial and professional gain of his friends, including industries such as coal mining, offshore drilling, cash advance companies, and for-profit colleges," wrote Katelyn Caralle of the Washington Examiner.

Schweizer's book, based on extensive research, says that Obama acted to regulate certain industries in such a way that the regulations lowered the value of some of the companies, wrote Katelyn Caralle of the Washington Examiner. These actions let two family friends to profit handsomely on deals through their own investment firm.

Here's how it worked: Obama buddies Marty Nesbitt and Harreld Kirkpatrick III formed a private equity investment firm called Vistria, right around the time Obama was re-elected in 2012.

Nothing wrong with that, except, as Schweizer notes in his book, "A curious pattern began to emerge. Obama and his administration would attack industries with government power, which led to substantially lower valuations for these companies. Nesbitt and Vistria, or others close to Obama, could then acquire those assets for pennies on the dollar."

As an example, Schweizer cites the case of for-profit higher education schools like University of Phoenix, ITT Technical Institute, and DeVry University. In 2013, Obama blamed the schools for taking advantage of students by saddling them with massive amounts of student debt, ruining their credit and making a profit on it. He ordered the Federal Trade Commission to go after them.

In the case of the University of Phoenix, its parent Apollo Education Group was suspended after a Federal Trade Commission investigation in 2015. The following year, three companies, including Vistria, swooped in to buy what remained of Apollo at a price 90% below its share price before the investigation.

As Vistria's education investment portfolio bulged, a number of Obama Education Department officials, including Secretary of Education Arne Duncan, ended up taking high-level jobs with Vistria.

That's just one example. There are others.

Schweizer noted in his book, for instance, that both Vice President Joe Biden and Secretary of State John Kerry were deeply involved in trade and security talks with China even as that country began its aggressive campaign to expand its military and physical presence in the South China Sea. Contrary to standard diplomatic practice, however, both played "good cop," not seriously confronting China on its misbehavior.

Remember, Biden and Kerry were close friends from their years spent together in the Senate. So there was little surprise when Biden's son, Hunter, and Kerry's stepson, Christopher Heinz, one of the heirs to the Heinz ketchup fortune, went into business together in 2009.

They created a number of equity and real estate investment firms allied to Rosemont Capital, "the alternative investment fund of the Heinz Family Office."

So far so good. Except, "Over the next seven years, as both Joe Biden and John Kerry negotiated sensitive and high-stakes deals with foreign governments, Rosemont entities secured a series of exclusive deals with those same foreign governments."

In December of 2013, for instance, Biden traveled to China for talks. He brought Hunter Biden along. While there, the senior Biden soft-pedaled China's clear aggression, and played up the bilateral trade partnership. Ten days after the trip concluded, China's central bank, the Bank of China, set up a $1 billion investment joint venture called Bohai Harvest RST. For the record, the "RS" referred to Biden's son's firm, Rosemont Seneca.

That's questionable enough.

But months later, in July 2014, Secretary of State John Kerry traveled to China, also for talks. Kerry talked little of China's clear aggression, but did conspicuously note that "China and the United States represent the greatest economic alliance trading partnership in the history of humankind."

He should know. In the ensuing months, Chinese government-linked firms took major stakes in several of the firms owned or controlled by Hunter Biden and Chris Heinz, and provided them with massive funding totaling billions of dollars. Nor is this the only scandal involving John Kerry.

And this just scratches the surface. The book is a catalog, a virtual roadmap, to the way corrupt business gets done in Washington — and why Americans are smart to question why their representative go to Washington as paupers, and return as millionaires.

We can only hope that as Biden or Kerry gears up for a challenge to Trump in the 2020 presidential contest, they will receive the same relentless scrutiny that a Republican with the same record of venality would get. But we won't hold our breath.

Top Democrats are circulating a poll showing that one of the House's most progressive members — Rep. Alexandria Ocasio-Cortez — has become a definitional face for the party with a crucial group of swing voters.

Why it matters: These Democrats are sounding the alarm that swing voters know and dislike socialism, warning it could cost them the House and the presidency. The poll is making the rounds of some of the most influential Democrats in America.

"If all voters hear about is AOC, it could put the [House] majority at risk," said a top Democrat who is involved in 2020 congressional races. "[S]he's getting all the news and defining everyone else’s races."
The poll — taken in May, before Speaker Pelosi's latest run-in with AOC and the three other liberal House freshmen known as "The Squad" — included 1,003 likely general-election voters who are white and have two years or less of college education.

These are the "white, non-college voters" who embraced Donald Trump in 2016 but are needed by Democrats in swing House districts.
The group that took the poll shared the results with Axios on the condition that it not be named, because the group has to work with all parts of the party.
The findings:

Ocasio-Cortez was recognized by 74% of voters in the poll; 22% had a favorable view.
Rep. Ilhan Omar of Minnesota — another member of The Squad — was recognized by 53% of the voters; 9% (not a typo) had a favorable view.
Socialism was viewed favorably by 18% of the voters and unfavorably by 69%.

Capitalism was 56% favorable; 32% unfavorable.
"Socialism is toxic to these voters," said the top Democrat.
Between the lines: Dems are performing better with these voters than in 2016 (although still not as well as in 2018). So party leaders will continue to try to define themselves around more mainstream members.

The other side: Three members of The Squad — Omar, Rep. Rashida Tlaib of Michigan and Rep. Ayanna Pressley of Massachusetts — defended their approach while appearing in Philadelphia yesterday on a panel at the annual Netroots Nation conference, AP's Juana Summers reports:

"We never need to ask for permission or wait for an invitation to lead," Omar said, adding later that there's a "constant struggle oftentimes with people who have power about sharing that power."

President Trump went after Rep. Alexandria Ocasio-Cortez (D-NY) and her crew over the weekend. He pretty much said if they don’t like it here in America, they could leave. I couldn’t care less. This so-called “Squad,” or Leninist Girl Scout Troop from Hell, has been taking swipes with the Democratic leadership for weeks. AOC and House Speaker Nancy Pelosi don’t even talk to one another. It’s nasty. A full-blown Democratic civil war was brewing. I know that’s said a lot on both sides, but this could have been a true ‘going to the mattresses’ moment. And then Trump inserted himself, drawing the attention towards him and not the left wing blood sports that had been occurring on the Hill ever since Pelosi and moderate House Democrats pushed through the Senate border package, which was loathed by the far left. At their presser yesterday, it seemed that both wings had united and decided not to take the bait, only for these four horsewomen of the apocalypse to do just that—take the bait. This call for unity won’t stand. It cannot.

Rep. Ayanna Pressley (D-MA), who is the more low-profile of this crew drew the battle lines at Netroots Nation over the weekend: those black and Hispanic lawmakers who side with Speaker Pelosi are pretty much race traitors. Their agenda and Pelosi simply do not mesh. They will come to blows again soon. After all, the border situation still isn’t resolved and there is no doubt the Department of Homeland Security will need more money to deal with the overcrowding at the detention facilities, another problem exacerbated by Democratic intransigence on working with the Trump White House. And the president knows that retaking the House would be a positive step towards alleviating this crisis and accomplishing the rest of his agenda.

Republican leaders addressed President Trump's feud with "the Squad" of four freshman Democratic lawmakers during a Tuesday press conference on Capitol Hill. Trump tweeted that Reps. Ilhan Omar (MN), Rashida Tlaib (MI), Alexandria Ocasio-Cortez (NY) and Ayanna Pressley (MA) should "go back" to where they came from if they hate America so much.

"No," GOP Leader Kevin McCarthy said when asked if he believes the president’s tweets were racist. The real issue, McCarthy said, was ideology.

"This is socialism versus freedom," McCarthy said.

He was echoing the earlier sentiments of his colleague Liz Cheney, who serves as the House Republican Conference chairwoman.

White House Counselor Kellyanne Conway added a few exclamation points to that argument.

"Why the hell can't we condemn anti-Semitism?!" she sounded off on Fox News.

Love It Or Hate It, There's No Reason Not To Understand Trump's Tweets

Let’s begin with some items that are not exactly news bulletins: President Donald Trump does not communicate conservatism in the fashion of a William F. Buckley or a Charles Krauthammer. He prefers the punches of a brawler to the scalpel of a surgeon as he takes aim at critics. This style is precisely why he won, and it may figure prominently in his re-election.

Whether against his 2016 primary opponents, the constant media condemnation since he took office, or specific attacks that arise day-by-day, he has grabbed any tool in the box, not to merely disagree with his opponents, but to slap them around, to make them think twice about doing it again. Sometimes it works, sometimes it doesn’t. But it will not change.

That makes it important for supposedly smart people to try to figure out what’s going on—not just when the president launches a pre-dawn posting raid, but when the reactions miss the mark entirely.

Anyone who has paid casual attention to Donald Trump has noticed that if he goes after someone, his content can contain a mixture of laser focus and schoolyard taunt. This is what led to “Lyin’ Ted,” “Sleepy Joe” and “I like people who weren’t captured.” It yielded deprecating references to Marco Rubio’s height, Carly Fiorina’s face and Nancy Pelosi’s mental stability. This is what he does. Everyone is free to love it, hate it, tolerate it or ignore it, but after four years of Trump as candidate and president, there is no longer any excuse for mischaracterizing it.


We all know we live in a time of weaponized discourse. Everybody leaps to Defcon 1 for maximum effect in this era of cable news snippets and viral moments. Trump, in his way, has mastered the art of maximizing the effectiveness of such communication without repelling his base, because the base knows that his brawler style is just that—a style, a method, a way to make a point.

The point of the “Go back where they came from” Twitter salvo was to highlight the loyalties of the congresswomen currently enjoying the affectionate label “the Squad.” The Trump assertion is that Rep. Alexandria Ocasio-Cortez wants to fight for illegal immigrants over the larger interests of the country, with accompanying observations about Rep. Ilhan Omar’s focus on Somali refugees and Rep. Rashida Tlaib’s Palestinian roots, with trails leading from those specifics to an overall view of America that he finds annoyingly derisive.


His suggestion was not the banishment squealed about by dishonest media outlets. His offer was to apply their chosen solutions among the populations he feels they are fighting for, presumably to learn how undesirable those strategies would be in America, and then to return, presumably chastened.


This is classic Trump. “The Squad” knows it. The media knows it. The nervous Republicans being badgered to condemn him know it.

Yet still, we are buried in reflex cries of racism, with accompanying analysis that this time he has really hurt himself. The first is baseless, the second merely dumb.

I expect Democrats to launch the racism charge; it’s all they seem to have. I suppose I should expect no better from a media culture sworn to destroy him. But as news networks hemmed over whether to say “critics called the tweets racist” (which is true) or “the tweets were racist” (which is malicious mind-reading), there was insufficient attention to whether there was a reason to believe it.

There is none. This is a president that loves supporters of all races, and goes after critics of all races. His battles are about politics, policy and core beliefs. Those who support him could not care less about the sloppy assertion that these particular critics came from other countries (true of only Omar). But amid a crowded and sometimes incoherent rush of 2020 presidential hopefuls, the left has clearly chosen to maximize this moment as further evidence that Trump is cut from the cloth of the Klan and the Third Reich.


It is all meaningless noise.

Squad member Rep. Ayana Pressley led off a Monday news conference by calling the Trump tactic a “distraction,” issuing a call not to “take the bait.” It is hard to imagine a grander exercise in bait-swallowing than a four-woman news conference airing every grievance they could wedge into a half-hour of free TV.

During their spotlight moment, we heard Pressley refuse to acknowledge the Trump presidency, calling him merely “the occupant of the White House.” Rep. Omar recoiled at “the garbage coming out of his mouth.” Please, someone, tell me again, how he is so mean to them.

The left calls him Hitler, accuses him of rape and attacks his family. He swings back in his chosen fashion, but the outrage is reserved only for his tactics. Lather, rinse repeat. No minds are changed. Trump will not lose his base over this, and the Democrats will not realize new waves of support. The postures of both sides are baked into the casserole we will chew on until November of next year.


So since neither the president nor his detractors are likely to divert from familiar habits, all of us left to witness the spectacle should at least know what is happening, and what is not. In this moment, Trump is resorting to a maneuver he had used to great effect in battles in both the private and public sector, while his enemies default to their comfort zone as well-- tilting at the latest windmill in an attempt to finally, at long last, convince America that he is illegitimate at best, and a racist dictator at worst.

But as anyone paying attention will notice if they have eyes to see, Trump does not choose targets by race, but by the positions they take in opposition to his agenda. Those standing in his way may feel the heat of a thousand tweets, and some of them may contain factual hiccups and indelicate words. But the notion that they are born of racial animus is a concoction crafted by desperate foes.
