A few weeks ago, in his “Bigger Picture” column, the FLT’s Spencer Tulis wrote about a new farm bill in New York state and its possible effects on farms and farmworkers. The gist of the column was that quite a few workers wanted to (and needed to) work beyond the standard 40-hour work week for a variety of reasons. The new bill would make the farm responsible for paying time and a half after 40 hours, which most likely would not be affordable for many farms, therefore workers would no longer make the income they needed.

I too have experience with employees that wish to work as many hours as they can, and I’d like to ask our legislators what they make of this particular issue. I’ve heard:

“Hey Pete, I’ve got to get my girl a banging present for her birthday, you mind if I work extra hours til I save enough cash?”


And ...

“Hey Pete, I need to get my car fixed and it’s gonna be expensive. You mind if I grab some extra hours?”

Hey Pete ... hey Pete ... hey Pete.

Payroll is one of the largest expenses for most employers. And most employers find themselves juggling to accommodate staff needs with financial restrictions.

Unfortunately, the government can get between employers and their good intentions when it comes to accommodating staff, because after 40 hours, it’s time-and-a-half pay. If they could afford to pay someone that much, they most likely already would be doing so. But the reality is that wages are based on what is affordable for the output of the business. If your payroll is too high, you might be well liked, but you won’t last long.

So this causes a dilemma for those who want to help out folks who could use the extra income now and then.

Because here’s what happens in real life (And real life, by the way, is something most legislators don’t seem to understand. You should see some of the regulations that come out of Albany).

Say someone needs to make some extra cash. New car down payment, nice vacation, refrigerator dies, you name the reason. So they ask to work an extra 10 hours a week for the next five weeks until they save up the extra cash they need. If they’re full-time already, that means those extra hours are all at overtime. So if the employee is making 20 bucks an hour, the employer has to pay them 30 bucks an hour for all of those extra hours. So being nice and helping out the employee ends up costing the employer $500 in extra overtime pay.

To do that now and again is okay, but what about when it becomes a regular thing with several folks who all want to work extra? It would be financially unrealistic for the business to continue the practice.

So, the only alternative is for the employee to find a second job.

And at the second job they’d be the new person and most likely start out at the bottom of the pay scale. And of course no employer wants to hire someone to work five or 10 hours a week, so now not only are they working for less pay, they’re also working 50 to 60 hours a week between two jobs.


For straight pay.

So if they can do that at two places, why can’t they chose to do that at one place?

I completely understand that labor laws were written to protect employees from unscrupulous employers. And I know that at the heart of these regulations is the desire to help the little guy (or girl), but what if that person wants to have a say in how much they work? What if they say “Hey, I just want to work more to make more.”

Why can’t someone decide for themselves?

After all, here in America, you should be allowed to work as much as you want, shouldn’t you?

Trump lost by 3 million popular votes in 2016. He is the only modern president to never get to 50% approval so far. His 40% approval rating is going to be dropping by a lot once this whole Epstein shameful event comes to light.

Wow, we agree. you should have the freedom to decide how much you work. The government should not decide for you. The government keeps taking our freedom. Unfortunately, the government in NY just took freedom away from farm workers.

Also, agree on no reason for minimum wage, after all why does the government decide that someone can't be paid more.

Disagree, many companies pay minimum wage because that is what the government says they have to pay. The Swiss recently voted down a $25 minimum wage for that reason. You must wonder how all your so-called socialist countries survive without a minimum wage.

Why would anyone in their right mind support Nike after this latest round of nonsense? Why would any public company with an image to protect take advice from an athlete? How can our attention be sucked up by people with nothing better to do than complain about fireworks and tanks on the fourth of July? Our country seems be losing its mind, or at the very least, its sense of history and perspective. As a man who has always seemed comfortable with our country’s flag, I was hoping you might have some insight to share on this, especially today.

I think Nike has the right to decorate their shoes with whatever flag they desire. I think Kaepernick has the right to offer marketing advice to any company that'll take it. And I think you and I have the right to purchase whatever brand of tennis shoes we choose. The reason these rights exist, is because we live in the United States, and the reason the states are united, is because we decided, two and a half centuries ago, to be free of our British masters. So, we fought a war. Happily, the results of that war made us a free country. Then, four score and seven years later, we decided we could not call ourselves a free country, as long as slavery existed. So, we fought another war. Happily, the results of that war made us freer still. Had either conflict gone the other way, our county would not exist – not as we know it, anyway. And the flag we fly today would look nothing like the one I’m proud to stand for.

In other words, I’m tempted on this day to remind you that there’s nothing inherently dangerous about a sneaker company currying favor with a woke athlete, or fellow citizens complaining about displays of patriotism and military might. On the other hand, I think Ronald Reagan was right when he said we’re always one generation away from losing the freedoms we currently enjoy. Along with the siren song of socialism, the persistent promise of “free” stuff, and the breathtaking level of censorship on our college campuses, I worry about the growing belief among many that we can somehow improve our present by erasing our past; by toppling statues, outlawing “problematic” symbols, or rewriting specific pieces of our history in ways that leave us feeling less offended. George Orwell said it best…

“The most effective way to destroy a people is to deny and obliterate their understanding of history.”

Of course, Orwell also said this...

“If liberty means anything at all, it means the right to tell people what they do not want to hear.”

In other words, we can’t deny Kapernick’s right to speak his mind, but we shouldn't ignore the flaws in his thinking. He has argued that the Betsy Ross flag is “racist,” because it flew at a time when slavery was legal in America. By that definition, aren’t crosses are also racist? Weren’t they on churches attended by slave-owning congregants? Why not demand their removal? What about the Bald Eagle? Wasn't our national bird flying around when slaves were held? Why not protest it as well? What about the Great Seal? E Pluribus Unum? The Liberty Bell? It rang countless times while slavery was still the law of the land. Why not demand its removal? Kaepernick's argument is unpersuasive, not because it's unpopular, or unpatriotic. It's unpersuasive because it's completely void of logic.

As for the presence of tanks in parades, I’ll triple down with Orwell, even though its somewhat suspicious to quote an English writer on the occasion of our independence. But it’s tough to argue with this one.

“People sleep peaceably in their beds at night only because rough men stand ready to do violence on their behalf.”

A growing chorus of leaders and voters recognize that democracy is dying, and that institutional reform is necessary to restore it. If Democrats pull off a hat trick in 2020, and if party leaders are fearless about enacting all three components of the democracy agenda — killing the filibuster, expanding the Supreme Court and enacting an aggressive version of HR 1 — then the system can be un-rigged and the rule of law can be restored before it’s too late. Otherwise, we’re probably done as a democracy.

Fact Check: Actually, the Trump Economy is Benefitting the Very People Democrats Claim It Isn't

One of the trickier bits of political positioning facing Democrats this cycle is how to talk about the American economy. By nearly every metric, it's performing quite well. Unemployment is low, growth is pretty strong, wages are rising, the stock market is up -- and we're in the midst of the longest overall US economic expansion in recorded history. Roughly 70 percent of voters are optimistic about both their personal financial situation and the national picture, and a relatively unpopular president consistently earns his highest marks on this issue, which happens to be at the top of the pile in terms of importance. 2020 Democrats, unable to laud the successful GOP tax reform law or President Trump's reduction of burdensome regulations, are instead attempting to downplay the extent to which the economy is thriving. The Wall Street Journal's editorial tackled a number of these claims. The editors begin by laying out Democrats' complaints:

Democrats running for President see America as a Dickensian nightmare of inequality. It’s the best of times for millionaires and billionaires, and the worst of times for everybody else. Time to wake up from the Barack Obama economy, folks, and admit how many more Americans are prospering from the faster economic growth and tighter labor market after the policy changes of 2017...“Who is this economy really working for? It’s doing great for a thinner and thinner slice at the top,” Massachusetts Sen. Elizabeth Warren declared at the debate. “When you’ve got a government, when you’ve got an economy that does great for those with money and isn’t doing great for everyone else, that is corruption, pure and simple.” Sen. Cory Booker, who hails from high-tax New Jersey, moaned that “I live in a low-income black and brown community. I see every single day that this economy is not working for average Americans.” California Sen. Kamala Harris added: “You ask [the President], how are you measuring the greatness of this economy of yours? And they point to the jobless numbers.”

Their statistics-based response to Sen. Booker:

Start with Mr. Booker’s claim that minorities are being left behind. Really? The jobless rate for blacks is 6.2%, which is only 2.9 percentage-points higher than for whites versus a 4.6 percentage-point difference before the start of the 2008 recession. Unemployment has fallen twice as much among blacks as whites since December 2016. Nearly one million more blacks and two million more Hispanics are employed than when Barack Obama left office, and minorities account for more than half of all new jobs created during the Trump Presidency. Unemployment among black women has hovered near 5% for the last six months, the lowest since 1972, and a mere 3.5% of high school graduates are unemployed.

And what to make about Kamala's point about people working multiple jobs -- a variant of which she has previously been fact-checked over?


But what about Senator Harris’s assertion that folks are stringing together jobs to make ends meet? About 5% of Americans hold more than one job, and this rate has held relatively constant since 2010. Yet there are now 1.3 million fewer Americans working part-time for economic reasons than at the end of the Obama Presidency. A tighter job market is also pushing up wages for the average Cory or Kamala. Average hourly earnings for production-level manufacturing workers have grown at an annual rate of 2.8% during the Trump Presidency compared to 1.9% during Barack Obama’s second term. Production-level manufacturing wages have accelerated even faster in Pennsylvania, Michigan and Indiana. (See the nearby chart.) While parts of Appalachia continue to struggle from a decline in coal mining, shale-gas drilling has created thousands of jobs including downstream in pipeline construction and petrochemicals—all of which Democrats want to kill.

Finally, on income inequality -- Warren's hobby horse -- the Journal runs through the actual outcomes of conflicting approaches to economic policy. Results over rhetoric:

The Obama Democrats talked constantly about inequality rather than growth, and the result was less growth and more inequality. The Trump Administration has for the most part focused on growth. Its policy mix of deregulation and tax reform has unleashed more private investment and job creation that has lifted productivity and wages for the non-affluent. The result has been faster growth and less inequality. Corporate profits have grown four times as much during President Trump’s first two years than during Mr. Obama’s second term. Yet investor dividend payments increased more during the Obama Presidency as businesses pulled back on investing in equipment, buildings and workers. There are no guarantees this growth will continue, and bad trade and monetary policy could derail it. But the Democrats now running for President want to return to the Obama policy mix of high taxes, willy-nilly regulation and income redistribution, and more of it. To win the economic argument they have to deny the reality that Donald Trump’s policies are helping the Americans that Democratic policies left behind.

The warning about bad trade or monetary policy threatening the strength and durability of the ongoing expansion is an important one. One of the most disconcerting critiques of the Trump economy isn't that it's not really working for people, because it clearly is -- but rather, that it won't last. Things are undoubtedly cyclical, and no president can control wider economic forces, beyond implementing advantageous or deleterious policies. If the economy softens considerably over the next 15 months, this president will very likely fail to win a second term. But is that likely? A number of experts, some of whom have frequently seen their expectations surpassed in recent years, say so. But a recent New York Times report points to the strong June jobs report easing fears of trade wars hampering bottom-line progress. And this op/ed posits that the consulting boom has had a real impact in helping businesses make better logistical decisions about inventory and other planning matters, keeping balance sheets more stable across multiple industries:

I'll leave you with a final policy note. Democrats are universally supportive of hiking the federal minimum wage, but the nonpartisan (but not infallible) Congressional Budget Office says such a move would imperil more than one million American jobs:

It's settled science that minimum wage increases benefit some workers, but directly harm others by raising the cost of employment. Jobs are eliminated (sometimes through automation), hours are reduced, consumers' costs go up, and the difficulty of finding entry-level work is increased.
