The Senate confirmed attorney Daniel Bress to the 9th Circuit Court of Appeals on Tuesday, bringing the number of President Trump’s appointees on the court to seven.

Senators were divided along a party line vote, 53-45, which came after strong objections from California’s Democratic Sens. Dianne Feinstein and Kamala Harris. Neither one returned a blue slip on the nomination.

“Bress is not a part of California’s legal community,” Feinstein and Harris said in a statement.


While Bress, 40, grew up in California, he has practiced law in Washington since 2008.

His defenders said Bress has California connections — he has been a member of the State Bar since 2008 — and stellar credentials. He graduated with honors from both Harvard University and the University of Virginia law school, was a law clerk for Supreme Court Justice Antonin Scalia, and has won several professional awards.

He joins a court that has been among the nation’s most liberal appellate circuits for 30 years. Trump has attacked the Ninth Circuit as “biased” and “hostile” for its rulings against his administration on such issues as immigration, birth control and his ban on U.S. entry from a group of mostly Muslim nations.

With Bress’ confirmation, the court will have 16 judges appointed by Democratic presidents, 12 by Republicans and one vacancy. Judges Carlos Bea and Jay Bybee, both Republican appointees with conservative records, have announced plans to transfer to senior status with reduced caseloads — Bea when his successor is confirmed, Bybee by the end of the year — creating two more vacancies for Trump to fill. "Mr. Bress comes with strong credentials: the academic pedigree, the legal experience and most importantly a demonstrated commitment to the rule of law," Senate Majority Leader Mitch McConnell (R-Ky.) said ahead of the vote.

A growing chorus of leaders and voters recognize that democracy is dying, and that institutional reform is necessary to restore it. If Democrats pull off a hat trick in 2020, and if party leaders are fearless about enacting all three components of the democracy agenda — killing the filibuster, expanding the Supreme Court and enacting an aggressive version of HR 1 — then the system can be un-rigged and the rule of law can be restored before it’s too late. Otherwise, we’re probably done as a democracy.

I guess our democracy being destroyed doesn't bother you?

It’s a bad time for the Democrats as the president wins on prosperity and patriotism

Let’s be honest, the past few weeks have not been kind to the Democrat Party.

The Democrats were desperate to bounce back after their first round of presidential debates devolved into a circus of extremist rhetoric — but they just can’t seem to catch a break. President Trump, meanwhile, has been coasting on a wave of prosperity and patriotism.

According to the latest ABC News/Washington Post survey, which was conducted in the days immediately following the Democrats’ disastrous debate performances, the President’s job approval has just reached a new high. At 47 percent, the President’s approval rating among registered voters is now one point higher than Barack Obama’s was at the same point in his presidency.

Of course, it’s important to remember that the polling industry has historically underestimated Donald Trump’s support — most infamously in 2016, when almost every reputable pollster predicted that Hillary Clinton would win the presidential election. For that reason alone, President Trump’s recent surge in the polls should terrify the Democrats ahead of the 2020 election.

But the poll numbers released on Sunday merely capped off an already disastrous week for the Democrats, who were hoping for a lifeline or two over the long holiday weekend.

First came President Trump’s Independence Day address in Washington D.C., which many Democrats predicted would be nothing more than a partisan publicity stunt.

Former Vice President Joe Biden, for instance, said the President’s “Salute to America” was “designed more to stroke his ego than celebrate American ideals,” while House Majority Leader Steny Hoyer accused Trump of “forcing taxpayers to foot the bill for what amounts to a political rally.”

Contrary to the predictions of his political opponents, Donald Trump did not hijack the event to promote his own presidency. Instead, he delivered an eloquent speech that honored the true champions of American liberty.

“Today, we come together as one nation with this very special Salute to America,” President Trump said during the address. “We celebrate our history, our people, and the heroes who proudly defend our flag — the brave men and women of the United States Military.”

Despite intermittent thunderstorms, an enormous crowd blanketed the National Mall to hear the President’s patriotic speech, further compounding the frustration of Democrats who had hoped that the rain would depress attendance.

The Democrats were also eagerly anticipating the release of the June jobs report on Friday, encouraged by early forecasts of mediocre job creation. In fact, payroll processor ADP predicted that the economy would only add 102,000 jobs last month — a result that would have given President Trump’s critics a brief opportunity to question the effectiveness of his economic policies, if the projection had turned out to be accurate.

Instead, the Democrats were dealt their second major blow in as many days, as the report revealed that the U.S. economy created 224,000 new jobs in June, more than twice as many as ADP had forecast. The report also showed that wages increased by an impressive 3.1 percent in June, marking the 11th straight month that wage growth has been at or above 3 percent for hard working low- and middle-income Americans.

The results sharply contradicted the doom-and-gloom picture of the economy that the Democrat candidates painted during their debates, offering a timely reminder that the U.S. economy continues to enjoy historic prosperity under President Trump’s leadership.

The Democrats desperately needed to score some quick political points last week in order to recover from their horrendous display on the debate stage, but strong economic data and a masterful Independence Day address by the President dashed whatever hopes they might have had for a political windfall.

It’s truly a disastrous time for the Democrat Party.

Bolstered by a strong economy, Donald Trump reached the highest job approval rating of his career in the latest ABC News/Washington Post poll and runs competitively for re-election against four of five possible Democratic contenders. Yet he remains broadly unpopular across personal and professional measures, marking his vulnerabilities in the 2020 election.

Forty-four percent of Americans approve of Trump’s overall job performance, up a slight 5 percentage points from April and 2 points better than his peak early in his presidency. Still, 53% disapprove, keeping him at majority disapproval continuously for his first two and a half years in office, a record for any president in modern polling.

Dems 2020 Task: Convince Voters to Overlook Economy

On Oct. 28, 1980, in the final debate of his race against Jimmy Carter, Ronald Reagan asked a question that has come to define presidential politics.

“Next Tuesday all of you will go to the polls, will stand there in the polling place and make a decision,” Reagan said. “I think when you make that decision, it might be well if you would ask yourself, are you better off than you were four years ago?”

The answer for most voters was no, and Reagan won the election with 489 electoral votes to Carter’s 49.

The question, or some close variation of it, has popped up many times since. “Are you better off than you were four years ago?” asked Bill Clinton in 1992. (In 1996, seeking re-election, Clinton declared, “We are better off than we were four years ago.”)

“Are you better off than you were four years ago?” asked Barack Obama in 2008.

It worked for Clinton, and it worked for Obama. Now, the question is whether it will work for Donald Trump.

The president’s Democratic 2020 challengers face a daunting problem: Unless there is a serious economic downturn, the answer to the are-you-better-off question will work in the president’s favor, not his opponent’s.

The unemployment rate, 3.7 percent, is the lowest it has been in half a century. June’s employment report — 224,000 new jobs — brought another strong performance. The economy is growing at a slightly better than 3% annual rate. Most important, in the context of an election, wages have grown 3.1% over last year with low inflation — improvement that has not been seen in years.

Any commentary on the 2020 election should include the warning that things could change. But barring a significant reversal, in 2020 most voters would likely answer yes when asked if they are better off than they were four years ago. And then they would vote to re-elect the incumbent president.

That leaves Democrats with the task of convincing millions of Americans to vote against their economic interests, to choose a Democrat over the president, during a time of economic satisfaction.

How to do it? Some Democrats have chosen to argue that there is something so wrong with the president — he’s a racist, or he is an agent of Russia, or he is something equally terrible — that the traditional measures of a successful presidency do not apply.

Look at Democratic front-runner Joe Biden’s entry into the race. Biden’s announcement video focused entirely on the August 2017 white supremacist rally in Charlottesville, Virginia, in which a counter-demonstrator was murdered.

“We are in the battle for the soul of this nation,” Biden said. “If we give Donald Trump eight years in the White House, he will forever and fundamentally alter the character of this nation — who we are — and I cannot stand by and watch that happen.”

Fast-rising Democratic contender Kamala Harris chose another approach. “I know predators,” the former prosecutor said recently, “and we have a predator living in the White House.”

Other Democrats have portrayed Trump as a threat to American values, a threat to the rule of law, and a threat to the “norms” that guide our politics and lives.

Together, the message could be characterized as: Yes, the economy is growing, unemployment is low, and wages are rising. But America under a re-elected Trump would become a racist dystopia in which all the beliefs Americans hold near and dear would be under constant siege. How could any decent person vote to re-elect the president?

Beyond that, Democrats hope educated voters will be susceptible to anti-Trump social pressures, to being shamed out of voting for the president. The idea is that those voters will focus on their objections to the way Trump has conducted himself in office — the tweets! — and not on the economic results of his presidency. Indeed, a number of polls have shown that a significant group of voters who are happy about the economy still plan to vote against Trump.

“Trump’s tenure is straining one of the most enduring rules in presidential politics: the conviction that a strong economy benefits the party holding the White House,” wrote analyst Ron Brownstein in The Atlantic. “Across many of the key groups in the electorate, from young people to white college graduates, Trump’s job-approval rating consistently runs at least 25 points below the share of voters who hold positive views about either the national economy or their personal financial situation.”

Of course, Democrats can’t ignore the economy. So far, when they have addressed it, they haven’t been terribly creative, relying on the standard-issue Democratic critique of Republican presidents — that Trump is creating an economy that benefits only his rich friends.

“Who is this economy really working for?” asked Elizabeth Warren at the first Democratic debate. “It’s doing great for a thinner and thinner slice at the top.”

It’s not clear how well that will work. As The Wall Street Journal editorial board pointed out recently, under Trump, “wages are rising at the fastest rate in a decade for lower-skilled workers, and unemployment among less-educated Americans and minorities is near a record low.” The result of the president’s policies, the Journal argued, “has been faster growth and less inequality.”

Another way to say that is that millions of Americans are better off than they were four years ago. The question in 2020 will be whether that matters.

The financial world has been buzzing nervously about the rapidly rising risk of a recession as warning signs mount. Though many mainstream economists and commentators are finally starting to concede that a recession in the next year or two is likely, almost all of them downplay the likely severity of the coming recession by saying “but it will be short-lived!” and “we’re due for a healthy slowdown after a ten year expansion!” (economists were saying the same thing in 2006 and 2007 too). My view, however, is that virtually everyone is underestimating the tremendous economic risks that have built up globally during the past decade of extremely stimulative monetary policies. I believe that these unknown risks are going to rear their ugly heads with a vengeance in the coming recession and that heavily indebted governments will have far less firepower with which to rescue their economies like they did during the 2008 to 2009 Global Financial Crisis.

Epstein, Bean & Buck: The Democratic Donors' Sex-Creep Club

Well, well, well. “Follow the facts,” Democratic strategist Christine Pelosi now advises fellow liberals in the wake of billionaire and high-flying political financier Jeffrey Epstein’s child sex trafficking indictment this week. Some of “our faves” could be implicated in the long-festering scandal, the Pelosi daughter warned, so it’s time to “let the chips fall where they may.”

Too bad Ms. Pelosi’s mommy hasn’t adopted that same attitude of accountability. While serving as the highest-ranking elected woman in America for decades, San Fran Nan has chronically downplayed, whitewashed or excused the sleazy habits and alleged sexual improprieties of a long parade of Dem pervs — from former San Diego Mayor Bob Filner to former New York Reps. Eric Massa and Anthony Wiener to former Oregon Rep. David Wu to former Michigan Rep. John Conyers and current presidential candidate Joe Biden.

Since the woke-ty woke Democrats are now gung-ho on undoing special treatment of wealthy liberal sex creeps, perhaps they will soon be revisiting the matter of two of their other “faves,” Oregon real estate mogul and deep-pocketed left-wing White House donor Terry Bean and West Hollywood Clinton pal Ed Buck.

Here, let me help.

Terry Bean is the prominent gay rights activist who co-founded the influential Human Rights Campaign organization. He is also a veteran member of the board of the HRC Foundation, which disseminates Common Core-aligned “anti-bullying” material to children’s schools nationwide.

Like Epstein, Bean had a penchant for rubbing elbows and riding on planes with the powerful. Upon doling out more than $500,000 for President Barack Obama and the Democrats in 2012, he was rewarded with a much-publicized exclusive Air Force One ride with Obama. His Flickr account boasted glitzy pics with Michelle Obama and Bill Clinton.

Like Epstein, Bean also had a thing for young minors. In 2014, a grand jury charged him with horrifying sexual abuse allegations involving multiple victims — including a 15-year-old boy. After a sweeping investigation led by the Portland police department’s sex crime units and two county district attorney’s offices, authorities charged Bean with two felony counts of third-degree sodomy and one misdemeanor count of third-degree sex abuse. His 20-something boyfriend, Kiah Lawson, was indicted on third-degree sodomy and third-degree sexual abuse.

Allegations of Bean’s lurid sexual trysts with young men, which Lawson says the Democratic donor secretly videotaped, first surfaced in the local Willamette Week newspaper five years ago. Police say the pair enticed a 15-year-old boy to a hotel in Eugene, Oregon, after meeting him through the iPhone app Grinder, which helps men locate “local gay, bi and curious guys for dating.”

Bean wriggled out of prosecution by publicly dangling $220,000 a cash “compromise” with the alleged victim, who then suddenly refused to testify against him. A judge in the county where the politically influential Bean family reigned, promptly dismissed the charges. Case closed? Not so fast.

In January, government investigators filed new charges against Bean and Lawson after the alleged underage victim, now an adult, revealed that he had been ripped off by his attorney, who reportedly never delivered Bean’s payoff. The criminal trial is scheduled to begin in August. In May, a second alleged juvenile victim of Bean’s came forward with a civil lawsuit alleging the Dem donor sexually abused him three times when he was 17. The state Democratic party and several federal officials who have received donations from Bean have declined to return the money.

Then there’s Ed Buck, another Democratic gay rights leader and moneyman whose West Hollywood den was the scene of not one, but two overdose deaths of black men he allegedly paid for sex and drugs. An independent journalist/blogger, Jasmyne Cannick, who has investigated Buck’s sordid activities for several years, warned authorities that the influential campaign contributor was a “predator” who lured vulnerable minority men into his filthy orbit. This week, the mother of one of the dead men alleged Buck violated federal human trafficking laws and “knowingly utilized interstate commerce” to entice the victim to California “for the purpose of engaging in commercial sex acts.” Family members will mark the two-year anniversary of the death of one of the victims, Gemmel Moore, at the end of this month.

Buck has donated more than a half-million dollars to top California Democrats including current Gov. Gavin Newsom, former Gov. Jerry Brown, LA Mayor Eric Garcetti, and LA District Attorney Jackie Lacey.

That’s a lot of chips falling in the coffers of the party that claims to care most about sex assault and human trafficking victims.

Will Pelosi “follow the facts,” like her daughter recommends, or continue to cover up?

Yes lets the chips fall where they may. It is the only way save our democracy. I have no doubt some Democrats are involved but I am sure they are far outnumbered by Republicans including the president himself.

This press conference makes me respect Acosta even less than I did before. He’s trying to blame the state prosecutor, the line attorneys & paint himself as some hero who wanted to be sure Epstein got jail time.

The Media's Overwrought July 4 Debacle

It's fair to say that a week doesn't go by where President Trump doesn't want to be the center of attention. That being the case, he must be well-satisfied with events leading up to the Fourth of July. He succeeded in creating another full-blown media panic about the erosion of democracy and the collapse of civilian control of the military, all because he is behaving like a dictator. The "news" manufacturers wanted us to know Trump was bending the national holiday into a celebration of his love of self.

The Washington Post kicked off the hate-filled hyperbole when Trump first announced that he would be giving a speech at the Lincoln Memorial and wanted tanks on the Washington Mall and jet flyovers. Stop here and ponder: What in the world is wrong with the president of the United States delivering an address on America's birthday? And what is wrong with showing an infinitesimal display of her military might that ensures her freedoms?

Well, the cost, silly. With a $4.4 trillion federal budget, the country cannot afford it. In its "news" coverage, the Post decried the costs of having the Secret Service suffer the inconvenience of defending the president on such an occasion.

Over the years, the Post and its media brethren have aggressively defended our tax money going to every possible leftist adventure, including when "artists" sunk a crucifix with Jesus Christ in urine and made a painting depicting his mother surrounded by dung. But a celebration of America's armed forces on Independence Day? This was an outrageous waste of taxpayer dollars.



The Post didn't complain about the costs on Aug. 28, 2013, when Rev. Al Sharpton held an event on the same Washington Mall celebrating the 50th anniversary of Martin Luther King Jr.'s March on Washington, featuring speeches by then-President Barack Obama and former Presidents Jimmy Carter and Bill Clinton. No one at that partisan paper smelled a partisan event.


As with Sharpton's event, Trump's address in Normandy only one month ago was nothing like the media's horror-movie premonition. Trump spoke unselfishly about the greatness of America and the bravery of her military men and women. Commentators noted after the event that it was a dramatic recruitment pitch for the military, which has had trouble attracting recruits. It had nothing do with Trump.

How did the press get this so wrong? Obviously, as the Democrats begin trying to select a nominee to prevent Trump's re-election, the "objective" journalists don't want Trump to benefit from incumbency in any way. Thus, a speech honoring our nation on July 4 had to be denounced as a campaign rally. Their loathing of Trump led them to interpret his every tweet bragging about this tremendous forthcoming event as a sure sign it would be all about his ego and not about our history.


He's playing the press like an accordion. They are the campaign issue. They are the ones politicizing current events against the candidate they despise.



You can also blame the Pentagon. In a post-event segment on "PBS NewsHour," Mike Lyons, a Gulf War veteran and a non-resident fellow at the West Point Modern War Institute, complained that the president's critics inside the military "used the media, unfortunately, to get a lot of disinformation out with regard to how the thing was going to go, that general officers weren't happy about it." He lamented, "Their mission was to execute on what the president's vision was." Instead, they kvetched to eager reporters.

Well, that's embarrassing for the Democrats. In an attempt to slam what they view as President Donald J. Trump's inhumane treatment of illegal aliens and migrant children, the Democratic House Oversight Committee tweeted a picture of an overcrowded detention center. The only problem with this photo is that it was taken during President Barack Obama's term in office.

"Last week, members of our committee visited a detention center at the southern border and discovered grotesque treatment of children,” the tweet from Tuesday afternoon said. “This week, we are examining the inhumane treatment of the children in these detention centers.”

The 2020 Trump campaign war room quickly responded, saying, House Democrats are promoting their 'civil rights' hearing on 'kids in cages' and 'inhumane treatment' with a photo from 2014, when Joe Biden was Vice President. So dishonest!"

The House Dems subsequently deleted the tweet after realizing their error. This is not the first leftists have shot themselves in the foot while using Obama era photos to trash President Trump. As I've previously reported..."the conditions in these detention centers have arguably stayed the same or in some cases worsened. But, the current day reactions to the photos prove that the left's contrived condemnation, while ignoring the issue under President Obama, is nothing more than anti-Trump posturing rather than genuine concern for the plight of the migrants."

When Mary Katharine Ham and I speak publicly about our book, End of Discussion, we often spend a fair amount of time lingering on the subject of the Left's weaponization of identity politics. Leftists very frequently seek to disqualify opposing viewpoints by claiming that those with different ideas are motivated by prejudice or bigotry, citing a parade of "-isms" as a substitute for substantive debate. This has become such a standard form of discourse, we've argued, that when internal disagreements arise, many people apply the same demagogic tactics on their fellow partisans, having effectively forgotten how to argue in good faith or on the merits.

An example we've employed in the past is the minor tempest that was stirred when the left flank of the Democratic Party opposed a trade deal that was favored by President Obama. In advancing his position, Obama referred to one of his critics on this issue -- Senator Elizabeth Warren (who has other identity issues of her own making) -- as "Liz" in an interview. This touched off criticism within the party among some who charged that Obama's use of a nickname was dismissive and therefore sexist. Others, offended that Obama was being given the Republican treatment on that front, wondered whether lobbing false claims of sexism at the first black president might have some problematic racial undertones. Welcome to the Woke Whirlwind, Democrats.

Joe Biden has now been victimized by this same toxic environment, in which his (popular) 1970's stance on mandatory school busing has been turned into a cudgel to portray him as racially insensitive...by a woman of color who turns out to basically, um, share his policy position on the issue. The point of the attack wasn't the policy; it was the identity politics. And it was unleashed minutes after the aggressor asserted, to applause, that the audience wasn't interested in witnessing a nasty "food fight." She then promptly flung fist-full of mashed potatoes at Biden, and fundraised off of it by selling t-shirts celebrating that premeditated moment. Now we have the latest iteration of the revolution turning inward, with Alexandria Ocasio-Cortez furiously responding to pointed criticisms of her tactics and behavior from the Democratic Speaker of the House by rushing down the well-trod path to the identity politics well:

Those points were reportedly disseminated in a mass internal email among Democrats. It's true that AOC's chief of staff -- last seen wearing a shirt bearing the visage of a literal Nazi collaborator -- has indeed done precisely that. I expect that fact has been tucked away in the grievance file by his intra-party critics for the next time he or his boss are defending the Squad's anti-Semitism.
