Justice Department Ends Obama Era Practice of Forcing Federal Defendants to Donate to Leftist Activists

Attorney General Jeff Sessions announced early Wednesday morning the Department of Justice will no longer force defendants to send payments to third party special interests unrelated or unharmed in federal cases.

“When the federal government settles a case against a corporate wrongdoer, any settlement funds should go first to the victims and then to the American people— not to bankroll third-party special interest groups or the political friends of whoever is in power,” Sessions said in a statement. “Unfortunately, in recent years the Department of Justice has sometimes required or encouraged defendants to make these payments to third parties as a condition of settlement. With this directive, we are ending this practice and ensuring that settlement funds are only used to compensate victims, redress harm, and punish and deter unlawful conduct.”

Current DOJ officials argue that under the Obama administration, settlement payments were often made to "non-party, non-victim political groups" and required defendants to donate to activist groups as a way to finish or close a case.

Essentially, there was a slush fund for leftist groups set up through the Department of Justice. Billions of dollars were paid out to far-left groups like La Raza, Neighborworks, National Community Reinvestment Coalition, the National Urban League and extreme environmental groups after unrelated big bank settlements with JP Morgan, Bank of America, Citigroup and car company Volkswagen.

“Advocates for big government and progressive power are using the Justice Department to extort money from corporations,” Judicial Watch President Tom Fitton told Fox News earlier this year. “It’s a shakedown. It’s corrupt, pure and simple.”

In order to prevent this type of practice in the future, Congress has introduced legislation barring the Department from using settlement agreements as ways to fund activist groups.

Senate Judiciary Committee Chairman Chuck Grassley, who has been working on this issue for years, applauded the move.

“Today’s decision by the Attorney General to end the Justice Department’s use of settlement agreements to fund politically favored organizations is a win for the victims in such disputes and for checks and balances in government. Under the Constitution, Congress holds the purse strings. The laws Congress passes dictate how funds collected by the government should be used," Grassley said. "Often, it’s to support the victims in such disputes. But under the Obama administration, the Justice Department disregarded this separation of powers by repeatedly directing defendants to ‘donate’ hundreds of millions of dollars to the administration’s friends and allies, including those that Congress took deliberate steps to defund. These practices usurped Congress’s spending authority and opened wide the door for misuse of government funds—all without any oversight mechanisms/

“Since 2010, I’ve been working to shine a light on these misdeeds and to get answers from the Department. Today’s announcement is welcomed news for those of us who respect the rule of law and demand a more accountable government,” he continued.

Because I have faith that if you want to dig further that you can copy the headline into google. Nice that you did not disappoint.

And because the author cites actual people. Unlike your fake news that cites un-named sources. Give credit to CNN though, at the end of their story they admit they do not know if what they wrote was true or not LOL

In conclusion: those are not citations, they are quotes and at least CNN applies proper journalistic standards by providing fair disclosure, so/he you have no evidence to back up your nonsense and/or are too lazy or insincere to even try.

The more things change, the more they stay the same.

Good News: Trump Nominates New Set of Federal Judges, Including Three to Influential Circuit Courts
Guy Benson

With much of the media is fixated on Russia, Comey, and potential obstruction, other goings-on inside the Beltway are getting relatively scant attention. The White House is ramping up its focus on rebuilding US infrastructure (a common Trump campaign refrain), Republican Senators may be forging ahead with some progress on desperately-needed reforms to Obamacare's failing status quo, and the president has unveiled another substantial roster of nominees to fill federal court vacancies. Three names on the list are slated to serve on important and influent circuit courts of appeal -- including a woman Trump has tapped to assume Supreme Court Justice Neil Gorsuch's seat on the Tenth Circuit. Details:

One of the nominees, Colorado Supreme Court Justice Allison H. Eid, is being tapped by the president to fill a vacancy on the 10th U.S. Circuit Court of Appeals created when Justice Neil Gorsuch was confirmed for the Supreme Court in April. Justice Eid was on Mr. Trump’s list of conservative potential Supreme Court nominees that he presented to voters during the presidential campaign last year. She has served on Colorado’s high court since 2006, and previously was the state’s solicitor general. Mr. Trump also nominated U.S. District Court Judge Ralph R. Erickson of North Dakota for the 8th U.S. Circuit Court of Appeals, and said he intends to nominate University of Pennsylvania Law School professor Stephanos Bibas to serve on the 3rd U.S. Circuit Court of Appeals. Judge Erickson has served on the district court since 2003.
The picks are receiving high marks from conservative court watchers. Here's the Judicial Crisis Network's Carrie Severino's glowing statement:

“President Trump has just announced his latest batch of appellate and district court nominees. It's a fantastic list, again drawing on his previous success from his Supreme Court list, by nominating Colorado Supreme Court Justice Allison Eid to fill Justice Gorsuch's vacant seat on the U.S. Court of Appeals for the Tenth Circuit. Many of the nominees are well known in the conservative legal movement and have shown commitment to principled and evenhanded application of the law throughout their careers. For the many Americans whose top concern in November was electing a president who would put committed constitutionalists to the courts, this is another major victory.”
Prominent conservative-libertarian law professor Jonathan Adler joins the chorus of approval: "President Trump continues to put forward superlative judicial nominees with sterling credentials and impressive intellects. It's especially notable that President Trump continues to pick current and former academics for the appellate bench, more so than any recent President. This will only magnify the impact his nominees are likely to have on the federal courts," he said. In a May post about Trump's previous round of judicial nominees, I drew extra attention to a handful of names rumored to be possible future SCOTUS short-listers, in the event that Justice Kennedy retires and/or another justice leaves the Court. It's time to add Allison Eid as a serious contender within that elite cluster, having previously been included on the roster of Supreme Court options released by Trump's campaign.

During my stretch as a visiting fellow at Stanford's Hoover Institution this spring, I chatted with former conservative circuit court judge Michael McConnell, who himself was rumored to be a Supreme Court finalist during the Bush era. He offered fulsome praise for Trump's recently-announced picks, and predicted that Ms. Eid would be a top candidate to replace Gorsuch. Getting through a recent Senate confirmation process would also augment her SCOTUS resume, he said at the time -- noting that her youth, reliable judicial philosophy, winsome nature and toughness would make her an attractive option if and when a High Court vacancy opened up. McConnell nailed his first prediction; let's see if he was also onto something when he mused that Eid may be onto even bigger things, perhaps quite soon. And in case you were curious, it's not unprecedented, or even necessarily particularly unusual, for a recently-elevated circuit court judge or senior official to be nominated for the ultimate promotion in short order.

So far, the Senate has confirmed just one of Trump's circuit court selections, but thanks to the Reid Rule, Democrats are powerless to stop any of them without GOP assistance. The upper chamber should move these nominations through as rapidly as possible and continue the crucial work of undoing some of the damage President Obama inflicted by packing these lower courts with liberals. I'll leave you with this tidbit. It looks like after enduring some criticism for a glacial pace of administration nominations, Team Trump is picking up the slack at a pretty rapid rate:

Ya! The Republican senate stands up to Trump for the first time. Maybe they are starting to see the light!

http://www.politico.com/story/2017/06/14/senate-passes-russia-sanctions-trump-limits-239553

The Senate on Wednesday overwhelmingly approved a bipartisan package of new Russia sanctions that also lets Congress block President Donald Trump from easing or ending penalties against Moscow, the year's most significant GOP-imposed restriction on the White House.

Celebrating The Dignity of Work: President Trump Signs Executive Order Promoting Apprenticeships
Katie Pavlich

President Trump signed an executive order from the White House Thursday promoting private apprenticeships as a way for individuals to learn skills that ultimately lead to full-time jobs.

"We're here to celebrate the dignity of work," Trump said before the signing. "Apprenticeships place students into great jobs without the crippling debt of traditional four year college degrees."

“We will be removing federal restrictions that have prevented many different industries from creating apprenticeship programs,” he continued. “We have regulations on top of regulations. And in history, nobody has gotten rid of some of these regulations like the Trump administration.”

White House Special Advisor Ivanka Trump has been leading the apprenticeship project with Labor Secretary Alexander Acosta. Earlier this week, she traveled to a Wisconsin factory with the President to promote the program.

Purpose of the order:

America's education systems and workforce development programs are in need of reform. In today's rapidly changing economy, it is more important than ever to prepare workers to fill both existing and newly created jobs and to prepare workers for the jobs of the future. Higher education, however, is becoming increasingly unaffordable. Furthermore, many colleges and universities fail to help students graduate with the skills necessary to secure high-paying jobs in today's workforce. Far too many individuals today find themselves with crushing student debt and no direct connection to jobs.

Against this background, federally funded education and workforce development programs are not effectively serving American workers. Despite the billions of taxpayer dollars invested in these programs each year, many Americans are struggling to find full-time work. These Federal programs must do a better job matching unemployed American workers with open jobs, including the 350,000 manufacturing jobs currently available.

Expanding apprenticeships and reforming ineffective education and workforce development programs will help address these issues, enabling more Americans to obtain relevant skills and high-paying jobs. Apprenticeships provide paid, relevant workplace experiences and opportunities to develop skills that employers value. Additionally, they provide affordable paths to good jobs and, ultimately, careers.

Finally, federally funded education and workforce development programs that do not work must be improved or eliminated so that taxpayer dollars can be channeled to more effective uses.
Policy of the order:

It shall be the policy of the Federal Government to provide more affordable pathways to secure, high-paying jobs by promoting apprenticeships and effective workforce development programs, while easing the regulatory burden on such programs and reducing or eliminating taxpayer support for ineffective workforce development programs.

Yeah, he copied Obama's previous programs that in reality will only fund a FRACTION of that which Obama did: whistle
http://time.com/money/4820268/trump-apprenticeship-plan/

Trump - $ 200 Million (not taking into account deep cuts laid out in his proposed budget, which slashes Labor Department funding by 21% and guts training and employment services).

Obama - $265 Million (of which $175M was the first-ever programmatic funding for registered apprenticeships in the U.S.).

Chris Lu, Former Deputy Labor Secretary under Obama, said Trump’s executive order “is simply a funding shift from other training programs.”

Do you see the handwriting on the wall Trump? The Republican senators are abandoning you.

http://www.nbcnews.com/politics/congress...trump-s-n772826

The Senate easily passed legislation Thursday that would impose additional sanctions against Russia and limit the president's power to lift them in the future.

The Senate passed the bill, which also includes additional sanctions on Iran, by an overwhelming 98-2 vote with Sens. Rand Paul, R-Ky. and Bernie Sanders, I-Vt. voting against it.

On June 15, Department of Homeland Security Secretary John F. Kelly, after consulting with the Attorney General, signed a memorandum rescinding the November 20, 2014 memorandum that created the program known as Deferred Action for Parents of Americans and Lawful Permanent Residents (“DAPA”) because there is no credible path forward to litigate the currently enjoined policy.
The rescinded memo purported to provide a path for illegal aliens with a U.S. citizen or lawful permanent resident child to be considered for deferred action. To be considered for deferred action, an alien was required to satisfy six criteria:
(1) as of November 20, 2014, be the parent of a U.S. citizen or lawful permanent resident;
(2) have continuously resided here since before January 1, 2010;
(3) have been physically present here on November 20, 2014, and when applying for relief;
(4) have no lawful immigration status on that date;
(5) not fall within the Secretary’s enforcement priorities; and
(6) “present no other factors that, in the exercise of discretion, make [ ] the grant of deferred action inappropriate.”
Prior to implementation of DAPA, twenty-six states challenged the policies established in the DAPA memorandum in the U.S. District Court for the Southern District of Texas. The district court enjoined implementation of the DAPA memorandum, the United States Court of Appeals for the Fifth Circuit affirmed the district court’s decision, and the Supreme Court allowed the district court’s injunction to remain in place.
The rescinded policy also provided expanded work authorization for recipients under the DACA program for three years versus two years. This policy was also enjoined nationwide and has now been rescinded.
The June 15, 2012 memorandum that created the Deferred Action for Childhood Arrivals (DACA) program will remain in effect.

Trump has a big heart. LOL

http://www.motherjones.com/politics/2017/06/trump-rescinds-obamas-dapa-program/

Kelly said in a statement on Thursday he was rescinding the initiative, known as DAPA, because “there is no credible path forward to litigate the currently enjoined policy.”

An earlier program, Deferred Action for Childhood Arrivals (DACA), offers some 750,000 immigrants brought to the country illegally as children the chance to attend school and to work.

Trump has previously said his administration was devising a policy on how to deal with individuals covered by DACA, but no formal changes have been announced.

“They shouldn’t be very worried,” Trump said of DACA recipients in a January ABC News interview. “I do have a big heart.”

Trump's Cuba Policy: 10 Things You Need To Know
Katie Pavlich

President Donald Trump officially rescinded major parts of President Obama's "normalization of relations" with the Cuban regime Friday afternoon from Miami while keeping the door open for the government to submit a better deal for the Cuban people.

Here are ten things you need to know about the new policy.

1) The U.S. Embassy in Havana will remain open BOO

2) The Wet-Foot, Dry-Foot policy will not be reinstated after being ended under the Obama administration (Boo I wonder if the leftist courts will throw it out laugh )

3) The U.S. is open to the Cuban government submitting another deal, which will be scrutinized on a number of conditions

4) Cuba must take concrete steps toward open and Democratic elections for a deal to be made

5) Lifting of sanctions on the regime will only happen when political prisoners and dissidents are permanently released

6) Cuban workers must receive direct paychecks from businesses instead of being forced to route payments through the government

7) Travel for non-academic educational purposes by U.S. persons will be limited to group travel. Individual travel by U.S. persons to the country is no longer allowed.

8) Cuban-Americans are allowed to visit family in Cuba and can legally send monetary resources

9) Allows Americans to do business with private small businesses in the country, not the government. From the White House:

The new policy channels economic activities away from the Cuban military monopoly, Grupo de Administración Empresarial (GAESA), including most travel-related transactions, while allowing American individuals and entities to develop economic ties to the private, small business sector in Cuba. The new policy makes clear that the primary obstacle to the Cuban people’s prosperity and economic freedom is the Cuban military’s practice of controlling virtually every profitable sector of the economy. President Trump’s policy changes will encourage American commerce with free Cuban businesses and pressure the Cuban government to allow the Cuban people to expand the private sector.
10) The economic embargo has been reinstated (you can still legally buy Cuban rum and cigars)

The new policy will be implemented in 30-days after the Treasury Department sets up and reviews the new regulations.

Trump Lists His Demands for the Castro Regime
Cortney O'Brien

Sen. Marco Rubio (R-FL) joined Vice President Mike Pence and President Trump in Miami, Florida Friday to unveil the White House’s new Cuba policy.

Rubio heaped praise on the president for showing compassion toward the Cuban people, who continue to struggle under the dictatorial leadership of Raul Castro. In multiple conversations the two had since the election, Rubio shared that Trump asked him constantly, “What are we going to do about Cuba?”

Well, the president was on hand to explain just some of the ways he intends to empower the people of Cuba, starting by canceling many of the provisions in the Obama administration’s “one-sided” deal with the Castro regime.

“The Cuban American community has so much love,” Trump said, returning the warm welcome he received when he walked onstage. “I saw that immediately.”

He commended the community for building a vibrant culture in Miami, noting it is “a testament to what a free Cuba can be.”

“With God’s help, a free Cuba is what we will soon achieve,” he added.

President Trump proceeded to do what his predecessor failed to so many times – expose communism for the failure it is.

"Now that I am president we will expose the crimes of the Castro regime," he promised.

The president listed several demands his administration will be making of Castro. For instance, Trump informed the dictator that they will not be lifting sanctions on Cuba until all political prisoners are free, all parties are legalized, and free elections are scheduled. He also plans to restrict U.S. dollars going to a military that is the cause of the Castro regime, enforce the ban on tourism and embargo. He also demanded that investments “flow directly to the people so they can open private businesses.”

He wasn’t finished. The president demanded that Castro stop harboring fugitives and criminals like Joanne Chesimard, who escaped from prison in 1979 and has been hiding in Cuba ever since gaining political asylum in 1984.

Trump finished his remarks, and went to a nearby table to sign the new contract.

“America will expose the crimes of the Castro regime and stand with the Cuban people in their struggle for freedom,” he said.

According to Republican Senator Lindsey Graham, Donald Trump isn’t smart enough to have committed the alleged crimes that he’s being investigated for. As Graham points out, he’s not even competent enough to collude with his own government, so how could he have worked with the Russians?
