On June 30 at the Penn Yan village office a Village worker was caught on camera stealing money then fired, but not arrested, why?

What did the Village Office say when you asked them? What did the cops say?

I would say that its the Village's prerogative whether to file charges. If it was a "sting" to catch someone that they may have suspected stealing and they caught him it would not be unusual for them to let them resign and that would be the end of it.

Isn't the only legal way to get restituition is by filing charges though?

It's easy for the Village to let it slide...after all, it's not their money, really; it's the public's, seized under threat of penalty.

"helpme" has not provided enough info. Does "caught on camera" mean he was caught after a review of an in house camera or was he caught as a result of surveillance setup because of a specific investigation? In either event they probably recouped the money when they interviewed the person and then offered him/her a chance to resign or face criminal charges.

Losing a job is a far worse punishment then a petit larceny charge. The Village probably doesn't want the publicity of an arrest. If no one files a criminal complaint the issue is resolved.

The village clerk discovered money was missing from the water, sewer and electric payments, the camera was set up and the thief was caught. The stealing has been going on for sometime, maybe thousands of $$$ are missing, I first heard of this by over hearing the blond in the lobby talking to some of her co-workers about it, I wonder if that is why our water, sewer and electric rates are so high?

Well its good that the "village clerk" was on the ball and figured it out. If the clerk realized it I am sure there is a paper trail leading to the dollar amount missing. Maybe they are doing an audit to determine how much is missing before they decide to pursue anything criminally. Checks and balances, checks and balances, no institution or business is immune from this happening. If proper checks and balances are put in place AND followed it greatly reduces the chances of this happening!
