France Becomes First Country In Europe To Ban All Pesticides Linked To Bee Deaths

Through the enforcement of this ban, France has indeed moved beyond the apparent boundaries set by the European Union. While only three neonicotinoids had been outlawed by the EU, France went on to ban all five of them.

Moreover, this ban is applicable not only in outdoor fields but also within greenhouses.

Britain had initially opposed this ban, but they eventually came around after more evidence surfaced supporting this. More so, after researchers discovered these pesticides cause the mysterious “colony collapse disaster” among bees in Europe and elsewhere.

U.S. judge limits evidence in trial over Roundup cancer claims

U.S. District Judge Vince Chhabria in San Francisco in an order on Thursday granted Bayer unit Monsanto’s request to split an upcoming trial into two phases. The order initially bars lawyers for plaintiff Edwin Hardeman from introducing evidence that the company allegedly attempted to influence regulators and manipulate public opinion.

Thursday’s order applies to Hardeman’s case, which is scheduled to go to trial on Feb. 25, and two other so-called bellwether trials which will help determine the range of damages and define settlement options for the rest of the 620 Roundup cases before Chhabria.

But Hardeman’s lawyers contended that such evidence, including internal Monsanto documents, showed the company’s misconduct and were critical to California state court jury’s August 2018 decision to award $289 million in a similar case. The verdict sent Bayer shares tumbling though the award was later reduced to $78 million and is under appeal.

Under Chhabria’s order, evidence of Monsanto’s alleged misconduct would be allowed only if glyphosate was found to have caused Hardeman’s cancer and the trial proceeded to a second phase to determine Bayer’s liability.

What Foods Are Banned in Europe but Not Banned in the U.S.?

The European Union prohibits many food additives and various drugs that are widely used in American foods.

A 1958 amendment to the Food, Drug and Cosmetic Act prohibits the Food and Drug Administration from approving food additives that are linked to cancer, but an agency spokeswoman said that many substances that were in use before passage of the amendment, known as the Delaney amendment, are considered to have had prior approval and “therefore are not regulated as food additives.”

Ecuadorian peasants and ecologists win battle against GM crops

The lawsuit was filed after monitoring by Acción Ecológica and the Ombudsman in the soybean producing areas of the country found that glyphosate-tolerant GM soybeans had been planted, despite the fact that Ecuador is constitutionally a country free of GM seeds and crops.

In a first hearing, the judge had ordered that monitoring be carried out, with the participation of the plaintiffs together with the Ministry of Agriculture and Agrocalidad, the Animal and Plant Health Regulation Agency. The monitoring confirmed that GM soybean is being planted illegally in the area.

Faced with this evidence, the judge granted the protection order and pointed out that GM crops violate the rights to life, health, work, a healthy environment and the rights of nature.

In his sentence the judge ordered the Ministry of Agriculture:

- to decommission, eliminate, and burn all the GM crops found in the monitoring programme

- subject to the sowing period, to confiscate, eliminate, and burn all batches of GM seed to prevent new sowings


- to establish a permanent surveillance program to prevent the planting of GM crops in Ecuador (except for research purposes)


- to establish training of officials and to the peasants of the region on the dangers of GM crops


- as a reparation measure, to include on the ministry's website the inscription "Ecuador is a GM-free country"


- to send a notice to the Prosecutor's Office of all the areas where GM crops were found, in order to identify responsibility, by action or omission, for the entry of GM soy.

Commenting, Richard Intriago of the Federation of Peasant Organisations of the Coast (FECAOL) said, "This is a historical event, because since Ecuador declared itself a GMO-free country, all efforts have been made to violate the Constitution. The judge's decision strengthens our struggle."

The president of the Federation of the Agricultural Center of Quevedo, one of the plaintiff organisations, said, "This is just the beginning of our struggle, because now we have to ensure that the judge's decision is complied with."

PARIS (Reuters) - A French court canceled the license for one of Monsanto’s glyphosate-based weed killers on Tuesday over safety concerns, placing an immediate ban on Roundup Pro 360 in the latest legal blow to the Bayer-owned business.



A court in Lyon in southeast France ruled that the approval granted by French environment agency ANSES in 2017 for Roundup Pro 360 had failed to take into account potential health risks.

Monsanto Roundup Trial Tracker: New Developments

The story was picked up by media outlets around the world, and promoted by Monsanto and chemical industry allies. Google advertisements were even purchased promoting the story.

Now, new information revealed in court filings indicates just how heavy Monsanto’s hand was in pushing the narrative. In a January 15 court filing, Plaintiff’s attorneys cited internal Monsanto correspondence dated April 27, 2017 they say show that Monsanto executive Sam Murphey sent the desired narrative to Kelland with a slide deck of talking points and portions of the Blair deposition that was not filed in court. The attorneys said the correspondence shows the Monsanto executive asking her to publish an article accusing Dr. Blair of deceiving IARC.

The public cannot see the actual internal correspondence between Monsanto and Kelland because Monsanto and Bayer lawyers want it sealed from public view.

Half of Michigan bumblebee species dropped by 50 percent or more

“It’s a loss of flowers. Many of the bumblebees that are stable fly mainly earlier in the season and so they’re more on trees and shrubs. And then, many of the bumblebees that have declined fly later in the season and they’re more in prairies and they’re more on herbs and forbs,” Wood explained.

Prairie areas in Michigan have been disappearing.

On top of that, a class of pesticides introduced about 25 years ago, called neonicotinoids, has been linked to declining bee populations.

Minnesota Becomes 5th State to Restrict Use of Monsanto Herbicide

Because of this, Minnesota just joined four other states in restricting the use of the chemical for the 2019 growing season.

The decision follows 253 complaints of dicamba drift in 2017, impacting a total of 265,000 acres.

After state restrictions were put in place for the 2018 growing season, the number of complaints of “dicamba drift” dropped dramatically to 53, affecting only 1,800 acres.

Tennessee achieved similar results after becoming the fourth state to restrict the use of dicamba a year and a half ago.

This year’s tougher restrictions — including a shorter spraying season and greater buffers around non-GMO crops — are expected to reduce crop damage even further.

Although essentially no studies or tests were conducted to prove the safety of dicamba before the EPA approved it, there is already at least one study linking dicamba to lung and colon cancer, and another study linking it to non-Hodgkis lymphoma.

Canadian farmers will continue using glyphosate after Health Canada concluded that the active ingredient in Monsanto’s Roundup weed killer poses no human risks.
The federal agency dismissed eight notices of objection and assertions made in the so-called Monsanto Papers in 2017.

“After a thorough scientific review, we have concluded that the concerns raised by the objectors could not be scientifically supported when considering the entire body of relevant data. The objections raised did not create doubt or concern regarding the scientific basis for the 2017 re-evaluation decision for glyphosate,” Health Canada said in a press release.

The bottom line is that glyphosate (marketed as Roundup, among other brands) is incredibly unsafe. As to whether it causes cancer, the most generous statement is that the science is unclear. But dig a little deeper. According to the Union of Concerned Scientists, many of the studies that cleared glyphosate were actually funded by Monsanto (now part of Bayer AG). And not only is glyphosate harmful when it is sprayed, it stays harmful even after it breaks down.

Drawing this back to our beautiful Island, there are many reasons that we are better off taking glyphosate products off our shelves, and finding alternatives. And that is an important first point: There are alternatives to glyphosate, including safer chemicals, natural products, and even goatscaping.



And finally, I would like the dispel the notion that we cannot move to ban glyphosate and other chemicals because everyone uses them. We once had widespread use of lead paint and dichlorodiphenyltrichloroethane (DDT). But when we found out that they were extremely dangerous, we stopped using them. We can do the same for any of the numerous chemicals on the market now that we know are unsafe.

Monsanto Hires Internet Trolls to Cover Up Roundup’s Cancer Risk - 2017

Internet trolls, paid for by Monsanto, have been scouring the internet to hide the ugly truth about the herbicide Roundup and the dangers of glyphosate, while the chemical giant worked with government regulators to declare the product safe to use, even though it "probably" causes cancer.

According to court documents, Monsanto hired third parties to search out negative comments about their products and counter them with pseudo-scientific research commissioned by the company itself.

Mike Papantonio, of America's Lawyer, predicts that Monsanto will pay heavily in a jury trial and describes how the company even has trolled The Ring of Fire, while manipulating the U.S. Food and Drug Administration and the U.S. Environmental Protection Agency (EPA).



In the wake of that report, Monsanto stepped up their efforts to keep the public in the dark about the dangerous product. Dr. William Moar, a Monsanto executive, said at a conference in 2015 that the company had "an entire department" with the sole purpose of "debunking" science that threatened their bottom line, like the IARC report.

Now a new peer-reviewed article answers the question of how and why the US EPA and EFSA reached diametrically opposed conclusions to IARC about glyphosate’s genotoxicity.[1] The article shows that the EPA relied on unpublished industry studies, 99% of which found that glyphosate was not genotoxic, whereas IARC relied on published studies, 74% of which found that glyphosate was genotoxic.

The EPA's "no genotoxicity risk" judgement on glyphosate was essential to its "no carcinogenic risk" classification of the chemical. The article shows that only by framing and constraining its genotoxicity assessment in a highly selective and biased way was the EPA able to conclude that glyphosate was not genotoxic. It also demonstrates that the EPA's cancer classification – as well as EFSA’s, which was based on the same data and was reached in a similar way – is scientifically baseless. Overall, the article shows that the way pesticides are assessed for risk is not fit for purpose and exposes people and the environment to unacceptable risks.

The paper is authored by Dr Charles Benbrook and is published in Environmental Sciences Europe.

EU Parliament adopts strong recommendations to protect health and environment from pesticides

Yesterday, the Greens/EFA Group published a study demonstrating that the German Federal Institute for Risk Assessment (BfR) in its assessments of the health effects of glyphosate partly plagiarised assessments directly from Monsanto (now Bayer), the glyphosate producer that led the Glyphosate Task Force. The BfR adopted the chemical giant's own assessments of the potential damage to humans and the environment from glyphosate, without clearly indicating the true source in their final report. In doing so, the BfR dismissed all independent scientific studies indicating potential carcinogenic effects.

Bart Staes, rapporteur on the Special Committee on Pesticide Authorisation report, commented:

"The European Parliament has listened to EU citizens, who expressed calls through the European Citizen Initiative (ECI). In conducting its work, the PEST committee has not bowed to the pressure of the pesticides lobby and is demanding strong action to protect health and the environment. The overwhelming support for reform of the pesticide authorisation procedure is a wakeup call for EU governments and the Commission and also a success for the ECI and public protests throughout the glyphosate debate.

"The Special Committee has brought to light serious shortcomings in the authorisation of pesticides. We must now put an end to the secrecy, the conflicts of interest and the fact that governments are depending too heavily on chemical giants such as Monsanto. The copy and paste in the approval case of glyphosate must be a lesson for more transparency and independent assessment in the authorisation of dangerous substances.

"The Committee could not resolve the controversy around the carcinogenicity of glyphosate and for that reason has asked for a systematic review of all relevant science. The next round of decisions on whether to ban glyphosate from our fields will be in 2022. Any future decision on glyphosate must fully consider independent scientific studies and ensure objective and transparent decision-making around the cancer risks and threats to biodiversity that glyphosate poses.

Washington, D.C. – Today, Center for Food Safety (CFS) filed a new legal action demanding the Department of Agriculture (USDA) prohibit hydroponic operations from the Organic label. Hydroponic production systems—a catch-all term that applies to food production methods that do not use soil—do not meet federal organic standards and violate organic law, which requires that organic farming include soil improvement and biodiversity conservation. Hydroponic systems cannot comply with the organic standard's vital soil standards because hydroponic crops do not use soil at all. The CFS filing was endorsed by over a dozen other organic farmer, consumer, retailer, and certifying organizations, including the Organic Farmers Association, Northeast Organic Dairy Producers Alliance (NODPA), PCC Community Markets, and the Cornucopia Institute.

"Mislabeling mega-hydroponic operations as 'organic' is contrary to the text and basic principles of the organic standard. Right now there is a pitched battle for the future of organic, and we stand with organic farmers and consumers who believe the label must retain its integrity," said George Kimbrell, CFS legal director.

Consumers trust the organic label and pay extra for the assurance that it indicates a more healthful and environmentally-friendly way of producing the food they buy. Since the federal Certified Organic label was introduced more than twenty years ago, the organic food market has grown exponentially and is now a $60 billion industry in which multinational corporations have bought organic brands and compete with small food producers growing food using environmentally-friendly methods.

"Allowing hydroponic systems to be certified as organic undercuts the livelihood of organic farmers that take great lengths to support healthy soil as the bedrock of their farms," stated Kate Mendenhall of the Organic Farmers Association. Howard’s newly updated seed chart is similar but even starker. It shows how weak antitrust law enforcement and oversight by the U.S. Department of Justice (DOJ) has allowed a handful of firms to amass enormous market, economic, and political power over our global seed supply. The newest findings show that the Big 6 (Monsanto, DuPont, Syngenta, Dow, Bayer, and BASF) have consolidated into a Big 4 dominated by Bayer and Corteva (a new firm created as a result of the Dow–DuPont merger), and rounded out with ChemChina and BASF. These four firms control more than 60 percent of global proprietary seed sales.

Howard began his annual tracking of seed industry ownership changes in 1998, a year that served as a turning point for industry consolidation. Two years after genetically engineered (GE) varieties were introduced in 1996, by 1998 the large agribusiness companies had accelerated their consolidation by buying up smaller firms to accumulate more intellectual property (IP) rights. By 2008, Monsanto’s patented genetics alone were planted on 80 percent of U.S. corn acres, 86 percent of cotton acres, and 92 percent of soybean acres. Today, these percentages are even higher.

Glyphosate Causes Cancer: EPA “Trade Secret” Sealed Files Reveal Cancer Link Known Back in the 1970s - 2015

Dr. Samsel is a research scientist and consultant who has been studying the toxicity of glyphosate, the world’s most prevalent herbicide used in commercial agriculture on GMO crops, for many years now. He has authored several papers with Dr. Stephanie Seneff on the toxicity of glyposate, including:



The biotech agricultural community has laughed off these studies primarily by attacking Dr. Samsel and Dr. Seneff’s credentials on this topic.

However, they are not laughing anymore.



In this interview, Dr. Anthony Samsel states that he now has documents received from the EPA which are “trade secret” documents belonging to Monsanto. These documents allegedly are safety studies about glyphosate from the late 1970s to the early 1980s, and others beyond those dates.

Samsel discusses one particular study on rabbits that looked at the effects of glyphosate on the skin. They monitored the rabbits’ blood chemistry, and one of their findings found an increase of lactate dehydrogenase, an enzyme in the blood related to tissue damage.

Another study, according to Samsel, showed that glyphosate went right into the animal’s bone marrow. Samsel claims this is dangerous, because new cells are born in the marrow and pass on to the thymus gland, where T-cells and white blood cells are eventually formed. Samsel considers this significant, especially in light of the recent WHO report that listed glyphosate as “probably carcinogenic” in causing non-Hodgkin lymphoma and prostate cancer.

Next Samsel discussed long-term studies conducted in rats that lasted 26 months. He considers those studies very significant. The reason they are very significant, is because they used a control group and much lower doses of glyphosate. Most people believe that the higher the exposure to the herbicide, the greater the effect. Samsel stated that glyphosate has an “inverse dose response relationship,” and that this is clearly shown in the Monsanto “trade secret” studies.

According to Samsel, these studies from 1978 to 1980 by Biodynamics in New Jersey clearly showed tumor growths in many organs at low doses of glyphosate. These studies were submitted to the EPA in 1981. The studies showed significant tumor growth in organs such as the kidneys, but these studies were dismissed as “not significant,” primarily by allegedly manipulating the control groups.



In Part 2, Dr. Samsel explains how one of the ways Monsanto was able to dismiss results of their studies was by using a standard lab animal feed supplied by Purina, which is known to increase carcinomas. This animal feed was in the “control” animals, to minimize the effects of the results in animals exposed to glyphosate. Samsel states that he has “several studies” that show this link between the lab feed and cancers.

Harvesting of sugarcane often begins before the sugarcane reaches the desirable maturity level. The only sugarcane ripener currently registered for use in the United States is glyphosate applied before harvest. The herbicide fluazifop is used as the primary ripener of sugarcane in South Africa. The herbicides glyphosate, fluazifop, and sulfometuron-methyl and the growth regulators ethephon and trinexapac-ethyl are registered for use in Brazil. There is a continuing need to evaluate sugarcane ripeners to increase the utility of currently registered ripeners and to find additional ripeners for use by sugarcane industries. In a blow to Bayer, judge to allow controversial evidence in Roundup cancer trials

Chhabria on Monday said plaintiffs could introduce some evidence of Monsanto's alleged attempts to ghostwrite studies and influence the findings of scientists and regulators during the first phase of upcoming trials. He said documents which showed the company taking a position on the science or a study introduced during the first phase were "super relevant."

The company had hoped the judge would take a harder line on such evidence following a Jan. 3 order by Chhabria restricting evidence of corporate misconduct. At the time, that decision lifted Bayer's shares nearly 7 percent.

Monsanto had argued much of this evidence was a "sideshow" that would only distract jurors from the scientific evidence.

Plaintiffs' lawyers contended some evidence of corporate misconduct was inextricably linked to their scientific claims.

The judge appeared to agree with them, saying it was difficult to draw the line between scientific evidence and allegations of corporate misconduct, and questioned whether it would be fair for the jury to not hear about the company's alleged attempts to influence scientists.



The order applies to Hardeman's case, which is scheduled to go to trial on Feb. 25, and two other upcoming cases. There are some 620 Roundup cases before Chhabria, out of more than 9,300 nationwide.

We must not allow this Farm Bill to be the final word on a number of critical environmental and public health issues facing the nation and world. That is why it is absolutely critical that we get to work immediately, with the new Congress, to set a new course that transforms the institutions of government that are holding back the urgently needed transition to a green economy.

On the Farm Bill, our victories were mostly measured in terms of what we were able to remove from the legislation—not the standard of achievement that we need to face critical environmental threats.

The good. Our major victory in the Farm Bill does not move us forward, but simply protects the status quo of our democracy—protecting the power of states and local government to adopt pesticide restrictions that are more stringent than the federal government. With your help and the help of a broad network of local officials nationwide, we were able to stop a preemption provision from being inserted in the federal pesticide law. Although the victory was in defeating this provision, the chemical industry has awakened a new front in the pesticide reform movement. As a result of this provision, there is new momentum to reassert the rights of local governments and repeal state-level preemption of municipalities. Other environmental setbacks to the Endangered Species Act, Clean Water Act, and farmworker protection were taken out of the final bill. New research confirms GM causes massive off-target damage to plant genomes

In addition to identifying multiple complete and partial GM gene insertions, numerous large rearrangements of the plant genome were detected. Furthermore, epigenetic (gene regulatory) changes were also identified that could have a wide range of effects, from the silencing of the introduced GM gene to alterations in function of multiple host gene systems.



New gene editing techniques, which rely on tools such as CRISPR, often involve the use of Agrobacterium in order to deliver this system into plant cells and in some cases to insert new genetic material into the genome. Thus, new gene editing GM techniques will not solve the problems highlighted by this new study.

In addition, the tissue culture process that is an obligatory part of all GM processes, including gene editing, is already known to cause mutations on a vast scale. So the implications of the new paper from the Salk researchers are that the tissue culture-induced mutations will be piled on top of the damage caused by the Agrobacterium-mediated GM transformation process.



In other words, the new findings won't enable genetic engineers to prevent DNA damage in the first place, but only to more easily spot the lines in which they have caused the most unintended damage.

A BLENDED BIFURCATION by glyphosategirl

You may remember my fury about the trial bifurcation that Monsanto requested and Chhabria granted. Bifurcation means that the trial will be divided into two phases. Phase 1, or the “general causation phase”, will address whether scientific research says that glyphosate causes NHL. If the jury says that it can, Phase 2 will take place to assess punitive damages and liability. Only then will Plaintiff counsel be able to unleash the reams evidence of Monsanto’s deceptive behavior promoting glyphosate. Bayer’s attorneys won a strategic victory here, but they should take their (certainly gilded) moral compasses in for a check-up.



Monsanto similarly discredits all parties and organizations who know the glyphosate/Roundup/GMO truth. We are all part of this so-called sideshow. Sadly, we’ve all believed their lines for decades, but Mother Nature did not. There is a limit to how much we can pollute and damage our earth without consequences – like the widespread declines in human fertility over the past decade (btw, glyphosate slows human sperm motility and hampers ovarian folicular dynamics and gene expression in lambs). At the current rate of decline, I’m not sure my kids’ generation will be able to have children.



You may remember the report written by Dr. James Parry, who was hired by Monsanto to perform an analysis as to whether glyphosate can cause cancer. After Parry concluded that glyphosate and Roundup may be genotoxic, Monsanto sought a different scientist to say that glyphosate is not genotoxic. Monsanto’s criticism of the Parry report is highlighted in an internal email that the Plaintiff used in the Johnson trial, in which Monsanto’s Dr. Heydens wrote that Monsanto was not going to do the further genotox testing of the products that Dr. Parry suggested.

Monsanto claims that showing the email would simply be a “sideshow” that doesn’t have place in Phase 1. Monsanto continues that the Parry report itself doesn’t have a place in the science phase because it isn’t really a thorough scientific analysis. Chhabria counters that Monsanto WOULD have viewed it as a thorough analysis if it had reached a different conclusion.



That Mouse Tumor

OK readers – remember the 1983 Knezovich and Hogan mouse study and the mystery tumor? Briefly: the mystery tumor refers to the mouse study performed by Monsanto that showed that glyphosate caused cancer in the mice. The EPA subsequently labeled glyphosate as a carcinogen. Monsanto then hired a scientist to take another look through the slides and determine if anything was missed in the first search for cancer evidence in the mice. Lo and behold, this scientist found a tumor in the control group, thereby rendering the mouse study statistically insignificant and refuting the EPA’s carcinogen categorization.

Monsanto argues that internal Monsanto/EPA correspondence memos regarding Monsanto’s strategy to change the study outcome to non-carcinogenic should not be allowed until Phase 2. Chhabria, in a somewhat amused tone, asks if Monsanto’s recommendation would be that the jury should hear that initially there was no tumor found in the control group but later they found one. And that the jury shouldn’t learn the story about how the conclusion changed.



NOW – GET THIS!

Wisner describes that in their own review of the mouse slides in question, all of the slides were available to review EXCEPT the slide that questionably shows the control group tumor. That specific slide has been corrupted and can’t be analyzed.

There is a pause in the room. Chhabria looks a bit amused because the fact that the only slide that can’t be recovered is the controversial slide makes Monsanto look pretty bad. Wisner doesn’t even need to say a word, but emotionlessly says that maybe the slide was simply reviewed too many times back in the 80s and became unreadable.

DOJ Releases Formal Approval of Toxic Mega-Merger between Bayer and Monsanto

WASHINGTON, D.C. – The Department of Justice today formally announced its green light for the Bayer-Monsanto merger, conditional to further divestments from the two companies. This decision comes after DOJ received over one million public comments urging the agency to block the merger and overwhelming concern by farmers across the country.

The divestitures will do little to restore bargaining power to family farmers, ensure farmers have access to diverse seed varieties and prevent seed prices from rising. During this time of low commodity prices and struggling farm economy, DOJ failed to listen to the more than 93 percent of polled farmers and over 90 percent of Americans who are concerned about the merger.

In response to the merger’s approval, Tiffany Finck-Haynes, pesticides and pollinators program manager with Friends of the Earth, issued the following statement:

USDA Imposes the Worst Regulation Ever

In July 2016, Congress passed a law mandating that all food containing genetic material that has been modified with recombinant DNA or “gene-splicing” techniques bear labels clearly identifying it as “bioengineered.” The statute acknowledged that bioengineered food is neither more nor less safe than other food, but the new rule—the National Bioengineered Food Disclosure Standard, or NBFDS—won’t help consumers understand that. It will only leave them confused.

Under the NBFDS, two identical bottles of corn oil on a supermarket shelf could be labeled differently—one as bioengineered, one not—even though both were derived from the same field and are identical in processing and quality. Both labels would comply with the regulation because the new rule doesn’t require a label “if the food does not contain detectable genetically modified material.” The NBFDS allows manufacturers to make voluntary disclosures on such products, but not that they “may contain” bioengineered ingredients.

Abstract: A broad community of independent scientific researchers and scholars challenges recent claims of a consensus over the safety of genetically modified organisms (GMOs). In the following joint statement, the claimed consensus is shown to be an artificial construct that has been falsely perpetuated through diverse fora. Irrespective of contradictory evidence in the refereed literature, as documented below, the claim that there is now a consensus on the safety of GMOs continues to be widely and often uncritically aired. For decades, the safety of GMOs has been a hotly controversial topic that has been much debated around the world. Published results are contradictory, in part due to the range of different research methods employed, an inadequacy of available procedures, and differences in the analysis and interpretation of data. Such a lack of consensus on safety is also evidenced by the agreement of policymakers from over 160 countries - in the UN’s Cartagena Biosafety Protocol and the Guidelines of the Codex Alimentarius - to authorize careful case-by-case assessment of each GMO by national authorities to determine whether the particular construct satisfies the national criteria for ‘safe’. Rigorous assessment of GMO safety has been hampered by the lack of funding independent of proprietary interests. The joint statement developed and signed by over 300 independent researchers, and reproduced and published below, does not assert that GMOs are unsafe or safe. Rather, the statement concludes that the scarcity and contradictory nature of the scientific evidence published to date prevents conclusive claims of safety, or of lack of safety, of GMOs. Claims of consensus on the safety of GMOs are not supported by an objective analysis of the refereed literature.



2 There are no epidemiological studies investigating potential effects of GM food consumption on human Health

It is often claimed that ‘trillions of GM meals’ have been eaten in the US with no ill effects. However, no epidemiological studies in human populations have been carried out to establish whether there are any health effects associated with GM food consumption. As GM foods and other products are not monitored or labelled after release in North America, a major producer and consumer of GM crops, it is scientifically impossible to trace, let alone study, patterns of consumption and their impacts. Therefore, claims that GM foods are safe for human health based on the experience of North American populations have no scientific basis.

The resulting crops are usually called Bt crops. Cry toxins kill insects that eat the GMO crop because the toxin punches a hole in the membranes of the insect gut when it is ingested, causing the insect to immediately stop feeding and eventually die of septicaemia.

Cry toxins are controversial. Although the biotech industry claims they have narrow specificity, and are therefore safe for all organisms except so-called ‘target’ organisms, plenty of researchers disagree. They suspect that Cry toxins may affect many non-target species, even including mammals and humans (e.g. Dolezel et al., 2011; Latham et al., 2017; Zdziarski, et al., 2018).

The Cry toxin mode of action, we and others have noted, does not necessarily discriminate between species. Artificial ripening of sugarcane as a complement to natural maturity is possible because of the development of glyphosate, a plant growth regulator, for use as a chemical ripener that hastens sugarcane maturation and increases sugar yield per ton of cane and per acre. Glyphosate is the active ingredient in a number of herbicides, including several formulations of Roundup, a broad-spectrum burndown herbicide from Monsanto Company, and Touchdown from Syngenta Crop Protection. Roundup is used with Roundup Ready crops, in fallow-field weed control programs and in residential areas.

Glyphosate is also one of the most effective chemical ripeners used in the world. It apparently influences the way dry matter is partitioned in a plant, increasing the ratio of sugar to fiber and enhancing the level of sugar in the juice and cane. Glyphosate treatment, however, usually decreases cane yield after treatment by slowing cane growth and reducing stalk weight. In Louisiana, the effectiveness of glyphosate for ripening sugarcane is highly dependent upon the sugarcane variety, the rate of glyphosate applied, the treatment-to-harvest interval and the growing season.

Glyphosate was first approved by the U.S. Environmental Protection Agency to be labeled and marketed as the chemical ripener Polado in 1980 and later as Polado L for use as a management tool to increase sugar yield. Polado (or Polado L) was the only glyphosate formulation labeled for commercial use until 2003, when Touchdown IQ from Syngenta Crop Protection was approved by EPA. Court grants EPA new hearing on pesticide ban

The 9th U.S. Circuit Court of Appeals will reconsider outlawing chlorpyrifos, a pesticide banned by a three-judge panel in August, but that farm groups say is vital to food production.

A new hearing is a victory for the Environmental Protection Agency, as well as farm groups. A majority of the court's judges has voted to set aside the August ruling and rehear the case in late March in San Francisco.

A time and date has not been set. The case will be heard by 11 judges drawn by lot from the court's roster of judges.

The Trump EPA asked for rehearing after it was ordered in a 2-1 decision to cancel all uses of chlorpyrifos.

The American Farm Bureau Federation and more than two dozen other farm groups filed a court brief supporting the EPA's motion.

First Federal Monsanto Roundup Trial Begins Monday in San Francisco

February 21, 2019, San Francisco, California – – The trial of Edwin Hardeman v. Monsanto Company (now Bayer) will begin with opening arguments on Monday, February 25, 2019in U.S. District Court for the Northern District of California in San Francisco before Judge Vince Chhabria. Jury selection occurred on February 20, 2019 and a panel of seven women and two men were chosen. The trial is expected to last a month.

Mr. Hardeman’s case is the lead case of the federal multidistrict litigation (MDL) against Monsanto and the first of the group to proceed to trial. More than 1,600 cases in the MDL are pending before Judge Chhabria, all filed by plaintiffs who allege exposure to Monsanto’s Roundup weed killer caused them to develop non-Hodgkin lymphoma (NHL).



Edwin Hardeman and his wife spent decades living in Sonoma County, California, on 56 acres of land that was once used as an exotic animal refuge. Mr. Hardeman started using Roundup products to treat poison oak, overgrowth, and weeds on his property in the 1980s and continued heavy spray activity through 2012. In February of 2015, he was diagnosed with B-cell NHL, roughly a month before the International Agency for Research on Cancer (IARC) classified glyphosate, a key ingredient in Roundup, as a “probable human carcinogen.”

Exposure to glyphosate-based herbicides increases risk of non-Hodgkin lymphoma – new analysis

The paper is published in the journal Mutation Research/Reviews in Mutation Research, whose editor-in-chief is EPA toxicologist David DeMarini. Three of the study authors were members of the EPA's scientific advisory panel on glyphosate who have stated publicly that the EPA failed to follow proper scientific practices in its glyphosate assessment.

The authors state in their paper, "Together, all of the meta-analyses conducted to date, including our own, consistently report the same key finding: exposure to glyphosate, more precisely to GBHs [glyphosate-based herbicides], is associated with a statistically significant increased risk of NHL."

ABSTRACT: Persistent non-lethal doses of glyphosate in plant tissue may have implications for the edible and/or medicinal use of native plants. This study investigated native plants growing in northern British Columbia (BC), Canada, to determine glyphosate presence and location-within-tissue in select species of traditional-use value with different life strategies. Perennial herbaceous and woody plants were collected one year after forestry-based applications of glyphosate in the Peace River Region of BC. Shoot, fruit, and root portions of select species were analyzed for glyphosate and aminomethylphosphonic acid (AMPA) residues using HPLC-IPCMS. Glyphosate residues were found one-year post-application. The highest and most consistent levels of glyphosate and AMPA were found in herbaceous perennial root tissues, but shoot tissues and fruit were also shown to contain glyphosate in select species. Levels found in some cases were greater than expected. Findings indicate the ability of glyphosate to be stored in root structures of perennial plants during dormancy periods, and move up to shoot and fruit portions in years following applications in some species. Further investigation is required to determine the timeline associated with glyphosate presence in plant tissues.

Before we get to the coverage of the first Hardeman v Monsanto jury selection hearing, I need to update readers on the controversial claim made by Judge Chhabria at the hearing last Wednesday. As you may recall in my last post, Chhabria explained that lawyers effectively write the expert witness reports, with some editing performed by the expert. Well, one of the expert witnesses from this trial reached out to me with this comment:

I am sensing that there is a lot of animosity towards Monsanto up and down the NorCal coast.



After a break, there is a discussion of how many jurors there will be. I think, twelve, right? Wrong. Federal trial can have as few as six jurors, and the discussion is whether there will be nine or ten. The plaintiffs tell me later that, obviously, they want nine. Fewer is better because the verdict in federal court has to be unanimous, so one less juror to convince. Chhabria is leaning towards nine.

Monsanto: judge threatens to 'shut down' cancer patient's lawyer

Judge in Roundup maker’s first federal trial had banned discussion of the company’s alleged manipulation of science

Monsanto is facing its first federal trial over allegations that its Roundup weedkiller causes cancer, but a US judge has blocked attorneys from discussing the corporation’s alleged manipulation of science.

In an extraordinary move in a packed San Francisco courtroom on Monday, US judge Vince Chhabria threatened to sanction and “shut down” a cancer patient’s attorney for violating his ban on talking about Monsanto’s influence on government regulators and cancer research.

“You’ve completely disregarded the limitations that were set upon you,” the visibly angry judge said to attorney Aimee Wagstaff, threatening to prevent her from continuing. “If you cross the line one more time … your opening statement will be over … If I see a single inappropriate thing on those slides, I’m shutting you down.”

The unusual conflict in the federal courtroom has fueled concerns among Monsanto’s critics that the trial may be unfairly stacked against the plaintiff, Edwin Hardeman, a 70-year-old Santa Rosa man who alleges that his exposure to Roundup over several decades caused his cancer. Building on long standing allegations, Hardeman’s lawyers and other critics have argued that Monsanto has for years suppressed negative studies and worked to promote and “ghostwrite” favorable studies about its herbicide to influence the public and regulators.

In a blow to the plaintiffs, Chhabria this year approved Monsanto’s request to prohibit Hardeman’s attorneys from raising allegations about the corporation’s conduct, saying issues about its influence on science and government were a “significant … distraction”. That means jurors must narrowly consider the studies surrounding Roundup’s cancer risks, and if they rule that Monsanto caused Hardeman’s illness, then in a second phase the jury would learn about the company’s conduct when assessing liability and punitive damages.

Hardeman’s trial is considered a “bellwether” case for hundreds of other federal plaintiffs who have made similar claims, meaning its outcome could have an impact on the course of future litigation and potential settlements. The high-stakes case comes amid growing global scrutiny of the health impacts of glyphosate, which is sold under the Roundup brand.

Concerns about the product escalated last August after a California jury issued an historic verdict, saying Monsanto was liable for a terminally ill man’s cancer and owed him $289m in damages. The groundbreaking ruling against Monsanto set the stage for a new wave of cancer litigation in the US and sparked regulatory debates and campaigns to restrict the chemical across the globe.

Monsanto is now owned by German pharmaceutical company Bayer, which suffered a 30% share price drop after the verdict and is now facing more than 9,000 similar lawsuits across the country.

Wagstaff told the Guardian last week before trial began that the limitations on evidence in the first phase meant the “jury will only hear half of the story”.

“The jury will hear about the science, but they won’t get to hear about how Monsanto influenced it,” she said. “The jury won’t have a complete understanding of the science. If we win without the jury knowing the complete science, that’s a real problem for Monsanto.”

Chhabria repeatedly interrupted Wagstaff’s opening statement Monday morning, reminding jurors that her comments did not constitute evidence and should be taken with a “grain of salt”. He also asked her to speed up when she was introducing Hardeman and his wife and discussing how they first met in 1975.

Wagstaff spoke in detail about the research on cancer and glyphosate, about some of Monsanto’s involvement in studies, and about the company’s communications with the Environmental Protection Agency. Eventually, the judge ordered the jury to take a break and issued his threat to sanction Wagstaff, though it was unclear which specific statements he had opposed.

When she tried to clarify her remarks, noting that she had clearly made the judge “upset”, Chhabria responded: “It’s not about being upset. It’s about running an orderly trial.”

He then ordered her to file a written motion by the end of the day arguing why he should not sanction her – and said he was considering a fine of $1,000.

The judge also said he didn’t trust her to continue using her prepared materials: “Should I save Ms Wagstaff from herself by barring her from further use of slides?” He ultimately allowed her to finish her opening statement. He ended the day by again attacking her opening remarks, saying her statements were “incredibly dumb”.

Hardeman, who sat in court with his wife, has alleged that his use of Roundup starting in 1986 to control poison oak and weeds on his property caused him to develop non-Hodgkin lymphoma (NHL), a cancer that affects the immune system.

Hardeman’s case builds on a key 2015 ruling by the World Health Organization’s international agency for research on cancer (IARC) that glyphosate was “probably carcinogenic to humans”, based on a review of existing research. Monsanto continues to argue that Roundup is safe, citing other studies. The company has also suggested Hardeman’s hepatitis C could be a possible cause of his cancer.

Brian Stekloff, Monsanto’s attorney, described NHL as a “common cancer” in his opening remarks, saying the cause is “unknown” for the vast majority of cases, adding: “Roundup did not cause Mr Hardeman’s non-Hodgkin lymphoma.”

A new report by the public-interest advocacy group U.S. PIRG reveals that tests of five wines and 15 beers, including organic ones, found traces of the controversial weed killer glyphosate in 19 out of the 20.

They include brands like Coors Light, Miller Lite, Budweiser, Corona, Heineken, Guinness, Stella Artois and Samuel Adams.

“The levels of glyphosate we found are not necessarily dangerous but are still concerning given the potential health risks,” U.S. PIRG said.

Glyphosate, a pesticide and herbicide best known as an ingredient in Monsanto’s Roundup, is a probable human carcinogen, according to the International Agency for Research on Cancer, a branch of the World Health Organization.

New Studies Confirm Dangers of Glyphosate

Rachel Shaffer, a co-author of the study at the University of Washington, stated of the results, “This research provides the most up-to-date analysis of glyphosate and its link with Non-Hodgkin Lymphoma, incorporating a 2018 study of more than 54,000 people who work as licensed pesticide applicators.”

Baltimore files lawsuit demanding Monsanto pay to clean up PCB chemicals in city waterways

The lawsuit says the contamination has caused monetary damages to be determined at trial.

100 Percent of Oat Products Tested Positive for Weedkiller Glyphosate

Oats, although not GE, are a common source of glyphosate residues because the chemical is used as a desiccant on many non-GMO crops. In northern, colder regions farmers of wheat, oats and barley must wait for their crops to dry out prior to harvest.

Rather than wait an additional two weeks or so for this to happen naturally, farmers realized they could spray the plants with glyphosate, killing the crops and accelerating their drying (a process known as desiccating).

In some cases, non-GMO foods may be even more contaminated with glyphosate than GMO crops, because they’re being sprayed just weeks prior to being made into your cereal, bread, cookies and the like.

Researchers from University of California San Diego (UCSD) School of Medicine noted in JAMA that Roundup is “applied as a desiccant to most small nongenetically modified grains.” So for both GE crops and non-GE grains, glyphosate “is found in these crops at harvest.”5 As an aside, beans are also desiccated using glyphosate, which is likely why FOE’s testing found such residues in all the pinto bean samples tested.

Monsanto Roundup Trial Tracker: New Developments

In another move applauded by Hardeman’s legal team, Chhabria said Monday that testimony about the “Parry report” can be presented to jurors. Monsanto objected but the judge agreed with plaintiff’s counsel that “the door has been opened to the Parry report” by Monsanto’s efforts to contest evidence of genotoxicity with glyphosate herbicides. Dr. James Parry was a consultant hired by Monsanto in the 1990s to weigh in on genotoxicity concerns being raised at the time by outside scientists. Parry’s report recommended that Monsanto do additional studies to “clarify the potential genotoxic activity” of glyphosate.



People around the world are following the trial proceedings, and the judge’s decision last week to sanction Hardeman’s lead attorney Aimee Wagstaff reportedly triggered a flood of emails from lawyers and other individuals offering support and expressing outrage at the judge’s action.

Chhabria worked at the firm between 2002-2004, a time period when Monsanto’s legal battle over Posilac was in high gear. The firm was reportedly involved in the issue in part by “sending letters to virtually all U.S. dairy processors, warning that they faced potential legal consequences if they labeled their consumer products as “rbGH-Free.”

Covington is perhaps best known for its work for the tobacco industry. A judge in Minnesota in 1997 ruled that the firm was willfully disregarding court orders to turn over certain documents pertaining to claims that the tobacco industry engaged in a 40-year conspiracy to mislead the public about the health impacts of smoking and hide damaging scientific research from public view.

Monsanto trial: cancer patient says he used herbicide for three decades

One of the plaintiff’s experts, pathologist Dennis Weisenburger, also testified about his research on NHL and cancer on Tuesday, saying: “When you get Roundup on your skin … it will penetrate the cells of the skin, it will get into the tissues, it will then get into the lymph system and into the blood.”

Why the Real Concern About Monsanto Is What We Still Don't Know

But it's the company's production and popularization of Roundup, the most widely used weed killer in the American agricultural system, that presents the scariest, and perhaps most impactful, potential danger Monsanto has ever posed. European Court of Justice Orders EU Regulators to Publicly Release Secret Industry Glyphosate Studies

The European Court of Justice (ECJ) has ordered the European Food Safety Authority (EFSA) to release all of the secret carcinogenicity and toxicity pesticide industry studies on glyphosate to the general public, in a huge legal victory for public health protection.



The concept of information which ‘relates to emissions into the environment’ must therefore be interpreted as covering not only information on emissions as such, namely information concerning the nature, composition, quantity, date and place of those emissions, but also data concerning the medium to long-term consequences of those emissions on the environment. The General Court concludes that the requested studies must be regarded as constituting information which ‘relates to emissions into the environment’ and that an overriding public interest in disclosing the studies is deemed to exist. EFSA could not therefore refuse to disclose them on the ground that that would have an adverse effect on the protection of the commercial interests of the owners of the requested studies.

Florida Cancer Patient Files Billion Dollar Glyphosate Lawsuit against Bayer

The lawsuit filed on Thursday said RoundUp weedkiller is responsible for LaFond’s cancer.

Attorneys said LaFond sprayed RoundUp every day for the two years she worked for a Lake Worth landscaping company, For Ever Green.

“She was actually essentially bathing in it,” said attorney Larry Strauss. “It was touching her skin. It’s aerosol, blowing on her face.”

For Ever Green is also named as a defendant in the lawsuit.

FDA Clears Way for AquaBounty to Raise Salmon in America’s Heartland


It’s been more than three years since the FDA approved salmon from AquaBounty Technologies, but debates about labels and other requirements have kept the genetically engineered fish from reaching dining plates. On Friday, the FDA removed the last regulatory hurdle standing in the company’s way.

The FDA lifted an “import alert,” a rule that kept AquaBounty from importing its salmon eggs. Maynard, MA-based AquaBounty owns a salmon farm in Canada that will supply the salmon eggs for its U.S. fish farm in Indiana. The FDA had already cleared that farm for operation. But until now, it was not authorized to bring in the genetically engineered salmon eggs, so it’s been stocked with traditional Atlantic salmon eggs. In a prepared statement, CEO Sylvia Wulf said AquaBounty will immediately start the process of importing eggs from Canada to grow in its Indiana facility.

On March 12, both sides in the Edwin Hardeman vs. Monsanto case delivered their closing arguments in San Francisco Federal Court.



In his ruling, Chhabria also wrote:

The judge worked for the firm when Monsanto was engulfed in an all-out legal battle over rBGH, a genetically engineered drug developed by Monsanto. The drug, which is injected into cows to boost milk production, increases levels of another hormone, IGF-1 which has been linked to breast, prostate, colon, lung and other cancers in humans.

Not only is rBGH dangerous to humans, but its use is considered inhumane as it causes a string of health problems in cows—painful udder infections, hoof problems and birth defects. To counter these health issues, dairy farmers use antibiotics, which in turn contributes to the rising threat of antibiotic resistance, as explained in a report by Physicians for Social Responsibility (PSR) Oregon Chapter.

The synthetic growth hormone, approved by the U.S. Food and Drug Administration in 1993, is banned in Europe and Canada.

Monsanto Roundup Trial Tracker: New Developments

If the jury does not unanimously decide either for Hardeman or Monsanto then the case would be a mistrial. Chhabria has also said that if that happens he is considering retrying it in May.

If the jury finds for Hardeman on causation, the trial would quickly move into Phase II using the same jury. And that is where things will really start to get interesting. Hardeman’s attorneys plan to call several Monsanto executives for testimony, including former Monsanto Chairman and CEO Hugh Grant. Grant spent more than 35 years at the company and was named CEO in 2003. He led the company until its acquisition by Bayer AG last summer.

Additionally, lawyers for Hardeman plan to call Roger McClellan, editor of the scientific journal Critical Reviews in Toxicology (CRT), which published a series of papers in September 2016 that rebuked the finding by the International Agency for Research on Cancer (IARC) finding that glyphosate was a probable human carcinogen. The papers purported to be written by independent scientists who found that the weight of evidence showed the weed killer was unlikely to pose any carcinogenic risk to people.

However, internal Monsanto documents show that the papers were conceptualized from the outset as a strategy by Monsanto to discredit IARC. One of Monsanto’s top scientists not only reviewed the manuscripts but had a hand in drafting and editing them, though that was not disclosed by CRT.

Hardeman’s lawyers additionally said they plan to call Doreen Manchester, of Croplife America, the agrochemical industry’s lobbying organization. Manchester’s role at CropLife has been helping “lead federal and state litigation to support pesticide regulatory issues.”

Third Roundup Cancer Trial Begins on March 25 in Oakland, California

March 8, 2019 – Oakland, California – –The trial of Pilliod v. Monsanto Company (now Bayer) begins with jury selection on Monday, March 25, 2019, in Superior Court of California for the County of Alameda before Judge Winifred Smith. Attorneys for the plaintiffs anticipate the trial will last about a month.

Pilliod v. Monsanto is the first case in the California Roundup Judicial Council Coordination Proceedings (JCCP) and the third Roundup cancer case to proceed to trial.

More than 250 Roundup cancer cases are consolidated before Judge Smith as part of the California Roundup JCCP. Plaintiffs in the lawsuit allege exposure to Monsanto’s Roundup weed killer caused them to develop non-Hodgkin lymphoma.

The first case to proceed to trial, Dewayne “Lee” Johnson v. Monsanto Co., resulted in a $289 million jury verdict in August, 2018, which the presiding judge later reduced to $78.5 million (Johnson v. Monsanto is a California state court case that is not part of the California Roundup JCCP). The Johnson case is currently on appeal. The Miller Firm LLC and Baum Hedlund Aristei & Goldman co-tried the Johnson case.

The second Monsanto Roundup cancer case to go to trial is currently underway in federal court in San Francisco. Attorneys Aimee Wagstaff (lead trial counsel) of Andrus Wagstaff and Jennifer Moore of Moore Law Group are trying the case of Hardeman vs Monsanto.

The case is Alva Pilliod and Alberta Pilliod v. Monsanto Company, Case No. RG17862702, JCCP No. 4953.

Alva Pilliod and his wife, Alberta, allege that long term exposure to Monsanto’s Roundup herbicide caused them to develop cancer (non-Hodgkin lymphoma). Alva and Alberta are both in their 70s and have been married for nearly 50 years.

Attorneys for the Pilliods, The Miller Firm, asked Judge Ioana Petrou (the couple’s original judge who has since been appointed to the First District Court of Appeal) to expedite trial due to their advanced ages and cancer diagnoses, according to court filings, like they did in the Johnson trial. Monsanto opposed their request for the expedited trial date but Judge Petrou found the couple’s ages and diagnoses warranted trial preference.

Alva suffers from non-Hodgkin lymphoma in his bones that spread to his pelvis and spine. He was diagnosed in 2011. Alberta’s non-Hodgkin lymphoma brain cancer diagnosis came in 2015. The couple started using Roundup in the 1970s and continued using the herbicide until only a few years ago. They have two children and four grandchildren.

Hypotheses proposed to explain these anomalies included contact with endocrine disrupting pesticides, such as imidacloprid. We evaluated the effects of imidacloprid experimentally at the South Dakota State University Wildlife and Fisheries Captive Facility where adult white-tailed deer females and their fawns were administered aqueous imidacloprid (an untreated control, 1,500&#8201;ng/L, 3,000&#8201;ng/L, and 15,000&#8201;ng/L). Water consumption, thyroid hormone function, behavioral responses, and skull and jawbone measurements were compared among treatments. Additionally, liver, spleen, genital, and brain imidacloprid concentrations were determined by an enzyme-linked immunosorbent assay (ELISA). Results indicated that 1) control deer consumed more water than treatment groups, 2) imidacloprid was present in the organs of our control group, indicating environmental contamination, 3) as imidacloprid increased in the spleen, fawn survival, thyroxine levels, jawbone lengths, body weight, and organ weights decreased, 4) adult female imidacloprid levels in the genitals were negatively correlated with genital organ weight and, 5) behavioral observations indicated that imidacloprid levels in spleens were negatively correlated with activity levels in adult females and fawns. Results demonstrate that imidacloprid has direct effects on white-tailed deer when administered at field–relevant doses.

WASHINGTON – Rep. Rosa DeLauro (D-Conn.) introduced legislation today to dramatically limit American children’s exposure to glyphosate, the active ingredient in Monsanto’s Roundup weedkiller, in food. The bill would not only ban late-harvest spraying of glyphosate on oats but also require the federal government to test foods popular with children for the herbicide, which has been linked to cancer.

Key provisions in DeLauro’s bill include:

Prohibiting the spraying of glyphosate as a pre-harvest drying agent on oats.
Lowering by 300-fold the permissible level of glyphosate residues on oats, restoring the legally allowed level to just 0.1 parts per million, or ppm.
Requiring the Department of Agriculture to regularly test fruits, vegetables and other foods routinely fed to infants and children for glyphosate residues.



O’Neil explained that in the past two decades, the Environmental Protection Agency has increased the level of glyphosate residue allowed on oats from 0.1 ppm to 30 ppm, largely to accommodate Canadian oat farmers who use it. The lax policy has resulted in the contamination of oat-based foods with the carcinogenic weedkiller.

Last year, independent laboratory tests commissioned by EWG found glyphosate residues in popular oat-based foods marketed to children, such as Cheerios and Quaker oatmeal. Almost three-fourths of the samples tested had glyphosate levels higher than what EWG scientists consider protective of children’s health with an adequate margin of safety.



“It is shocking that USDA’s annual pesticide residue survey fails to include the most widely used pesticide in America,” he said. “Parents deserve to know how much of the food they buy and feed their children could potentially be contaminated with a highly toxic chemical listed by the state of California as a substance known to cause cancer. A new study(1) has found that exposure to glyphosate-based herbicides (GBHs), including Roundup, caused reproductive and developmental effects in both male and female rats, at a dose level currently considered safe in the US (1.75 mg/kg bw/day).



AGD, the distance between the anus and the genitals, is a sensitive marker of prenatal endocrine disruption(2) affecting the genital tract development. Exposure to different chemicals including pesticides has been linked previously to altered AGDs and other endocrine effects(3)(4).

This is the fourth in a series of related papers(5) from the pilot phase of the Global Glyphosate Study. The first results of the pilot phase of the study were presented to the European Parliament on May 16, 2018. PARIS (Reuters) - A French court canceled the license for one of Monsanto’s glyphosate-based weedkillers on Tuesday over safety concerns, placing an immediate ban on Roundup Pro 360 in the latest legal blow to the Bayer-owned business.



A court in Lyon in southeast France ruled that the approval granted by French environment agency ANSES in 2017 for Roundup Pro 360 had failed to take into account potential health risks.

New analysis raises questions about EPA’s classification on glyphosate weed killer

Researcher says the EPA has disregarded substantial evidence that the popular herbicide is linked to cancer


According to the report, which examines the opposing positions taken by the EPA and an international cancer research agency on glyphosate-based herbicides, the EPA has disregarded substantial scientific evidence of genotoxicity associated with weed killing products such as Roundup and other Monsanto brands. Genotoxicity refers to a substance's destructive effect on a cell's genetic material. Genotoxins can cause mutations in cells that can lead to cancer.

The EPA classifies glyphosate as not likely to be carcinogenic while the International Agency for Research on Cancer (IARC), which is part of the World Health Organization, classifies it as "probably carcinogenic."

The paper was authored by Charles Benbrook, a former research professor who served at one time as executive director of the National Academy of Sciences board on agriculture, and was published in the journal Environmental Sciences Europe on Monday. It is based on Benbrook's review of EPA and IARC records regarding the types and numbers of glyphosate studies each organization evaluated.

"Clearly, compared to EPA's genotoxicity review, the IARC review is grounded on more recent, more sensitive, and more sophisticated genotoxic studies, and more accurately reflects real-world exposures," Benbrook told EHN.

Benbrook testified as an expert witness in the first lawsuit to go to trial against Monsanto over claims its glyphosate herbicides cause cancer. The plaintiff in that case, Dewayne "Lee" Johnson, won a unanimous jury award of $289 million last year that the judge in the case cut to $78 million. Thousands of additional cancer victims have sued Monsanto and the second trial begins Feb. 25 in federal court in San Francisco. Benbrook is also expected to testify for the plaintiff in that case.

Monsanto is seeking to exclude Benbrook's testimony at trial, saying he has no expertise in any physical science or field of medicine and no training or degree in toxicology and has never worked at the EPA or other regulatory body.



In the new analysis, Benbrook is critical of the EPA's scrutiny of glyphosate herbicides, noting that little weight was given to research regarding the actual formulations sold into the marketplace and used by millions of people around the world. Instead, the EPA and other regulators have mostly pointed to dozens of studies paid for by Monsanto and other companies selling glyphosate herbicides that found no cancer concerns. The EPA has given little attention to several independent research projects that have indicated the formulations can be more toxic than glyphosate alone, according to Benbrook.



According to Benbrook, the EPA's failure to focus on formulated glyphosate-based herbicides is dangerous because these formulations "account for all commercial uses and human exposures (no herbicide products contain just glyphosate)."

More research is needed on real-world exposures, Benbrook concludes.

Phase 1: Jury finds for the Plaintiff


Second U.S. jury finds Bayer's Roundup caused cancer


(Reuters) - A U.S. jury on Tuesday found Bayer AG’s glyphosate-based Roundup weed killer caused cancer, a blow to the company eight months after another jury issued a $289 million verdict over similar claims in a different case.

Tuesday’s unanimous jury decision in San Francisco federal court, which came after five days of deliberation, was not a finding of Bayer’s liability for the cancer of plaintiff Edwin Hardeman. Liability and damages will be decided by the same jury in a second trial phase beginning on Wednesday.

Bayer, which denies allegations that glyphosate or Roundup cause cancer, in a statement on Tuesday said it was disappointed with the jury’s initial decision. Bayer acquired Monsanto, the longtime maker of Roundup, for $63 billion last year.

“We are confident the evidence in phase two will show that Monsanto’s conduct has been appropriate and the company should not be liable for Mr. Hardeman’s cancer,” the company said.

Glyphosate is the world’s most widely used weed killer. Monsanto’s Roundup was the first glyphosate-based weed killer but is no longer patent-protected and many other versions are now available. Bayer does not provide sales figures for the product.

The case was only the second of some 11,200 Roundup lawsuits to go to trial in the United States. Another California man was awarded $289 million in August after a state court jury found Roundup caused his cancer, sending Bayer shares plunging at the time. That award was later reduced to $78 million and is on appeal.

Bayer had claimed that jury was overly influenced by plaintiffs’ lawyers allegations of corporate misconduct and did not focus on the science.

U.S. District Judge Vince Chhabria called such evidence “a distraction” from the scientific question of whether glyphosate causes cancer. He split the Hardeman case into two phases: one to decide causation, the other to determine Bayer’s potential liability and damages.

Under Chhabria’s order, the second phase would only take place if the jury found Roundup to be a substantial factor in causing Hardeman’s non-Hodgkin’s lymphoma. The jury found that it was on Tuesday.

NOT AN ABERRATION
Carl Tobias, a law professor at the University of Richmond, said Tuesday’s decision showed that the August jury verdict was not an aberration and that the Hardeman case could be an indication of what may happen in future similar cases.

Some legal experts had said Chhabria’s decision was beneficial to Bayer, which says decades of studies and regulatory evaluations have shown the weed killer to be safe for human use.

“We will only really know whether it works for Bayer to isolate scientific issues once we see more trials,” said Adam Zimmerman, a law professor focusing on mass torts at Los Angeles-based Loyola Law School.

Chhabria has scheduled another bellwether trial for May and a third trial is likely to take place this year. All three bellwether cases will be split into causation and liability phases.

The U.S. Environmental Protection Agency, the European Chemicals Agency and other regulators have found that glyphosate is not likely carcinogenic to humans. But the World Health Organization’s cancer arm in 2015 reached a different conclusion, classifying glyphosate as “probably carcinogenic to humans.”

In the trial’s second phase, Hardeman’s lawyers will be allowed to present evidence allegedly showing the company’s efforts to improperly influence scientists, regulators and the public about the safety of Roundup.

Hardeman’s lawyers, Aimee Wagstaff and Jennifer Moore, said they look forward to presenting that evidence to the jury to hold Monsanto accountable.

“Now we can focus on the evidence that Monsanto has not taken a responsible, objective approach to the safety of Roundup,” they said in a statement.

Chhabria is overseeing more than 760 Roundup cases for which Hardeman’s was a so-called bellwether trial intended to help determine the range of damages and define settlement options for the others.

Another Roundup trial is scheduled to begin in California state court in Oakland on March 28, involving a couple who claim Roundup caused their non-Hodgkin’s lymphoma.

Investors flee Bayer after second glyphosate trial blow (Update)

The threat to German chemical giant Bayer and subsidiary Monsanto from US litigation swelled Wednesday, when its share price plunged after a jury ruled weedkiller Roundup was a "substantial factor" in an amateur gardener's cancer.

A wave of lawsuits has put pressure on Bayer since its $63-billion takeover of Monsanto last year, spooking investors who worry damages payouts could quickly mount into the billions if the firm fails to convince courts its product is safe.

Chief executive Werner Baumann said last month the company faced a total of 11,200 US cases over Roundup and its active ingredient glyphosate, a herbicide key to Monsanto's business model that has come in for intense scrutiny around the world.

That mass of lawsuits meant markets shuddered after a federal court finding Tuesday that Roundup was behind the non-Hodgkin's lymphoma suffered by 70-year-old Edwin Hardeman, who used the product for decades on the garden at his California home.

The second major legal setback in a year set the Leverkusen-based group's stock ebbing well into Wednesday trading after an initial plunge.

By 11:20 am in Frankfurt (1020 GMT), the shares were trading down 13.2 percent at 60.53 euros ($68.71), dragging down the DAX index of blue-chip German shares.

Since the merger was completed, Bayer's stock has shed almost 40 percent of its value.

Tuesday's "decision... has no impact on future cases and trials because each one has its own factual and legal circumstances," Bayer said in a statement, adding that it stood behind science it says demonstrates glyphosate is safe.

But IG analyst Chris Beauchamp told AFP the prospect of thousands of plaintiffs potentially being awarded tens of millions of dollars each means investors "start doing the numbers, and it doesn't look very pretty at all".

The latest case has so far brought no damages award against Bayer, as jurors now have to decide whether Monsanto is liable for the harm suffered by Hardeman.

Fired Quebec scientist blew the whistle on pesticide lobby influence

In May 2009, Quebec government scientist Louis Robert was 15 minutes away from entering a conference room to give a lecture about phosphorus when he got a phone call from his boss ordering him to call it off.

His boss threatened to move Robert into another office to perform administrative tasks if he dared to proceed with the lecture.

A year earlier, a senior public servant summoned Robert to a meeting at a restaurant with his boss, in which the scientist was told to cancel an on-camera appearance with journalists to talk about the management of fertilizers.

The interview was scheduled to be four days away, but it was cancelled and the journalists were then forced to send their questions to the ministry to proceed with their reporting.

Both incidents were recounted in an email sent to National Observer by Robert's public sector union.

Robert was previously employed at Quebec's Agriculture Department for three decades.

All in all, the scientist was personally ordered to cancel these types of appearances "five to six" other times over the past few years, according to his union.

Throughout this period, the union said he was trying to alert his superiors about attempts by industry to suppress publicly-funded science on the health effects of pesticides.

Phosphorus is a mineral that can pollute water as a result of runoff from fertilizers used in agriculture. An overabundance can lead to the growth of toxic bacteria, for example on Canadian lakes.

His supervisors gave him the brush-off. Eventually he leaked a document to Radio-Canada, feeling he had an obligation to inform the public.



Robert had noticed that Christian Overbeek, the head of Quebec’s public body on grain research, which is majority funded by the ministry, is also the president of a trade group of producers and is a lobbyist. Overbeek has spoken against excessive regulation of pesticides, a central issue that the grain research body examines.

Robert also realized that the board of directors of the public research body was entirely filled with corporate representatives. In fact, management had been pressuring all sorts of researchers not to disseminate or interpret the results of research projects, while the board had tried to discourage them from publishing their results in scientific articles, according to the Radio-Canada investigation.

Weed killer residues found in 98 percent of Canadian honey samples

Study is the latest evidence that glyphosate herbicides are so pervasive that residues can be found in foods not produced by farmers using glyphosate.

As U.S. regulators continue to dance around the issue of testing foods for residues of glyphosate weed killers, government scientists in Canada have found the pesticide in 197 of 200 samples of honey they examined.

WASHINGTON – Rep. Rosa DeLauro (D-Conn.) introduced legislation today to dramatically limit American children’s exposure to glyphosate, the active ingredient in Monsanto’s Roundup weedkiller, in food. The bill would not only ban late-harvest spraying of glyphosate on oats but also require the federal government to test foods popular with children for the herbicide, which has been linked to cancer.

Key provisions in DeLauro’s bill include:

Prohibiting the spraying of glyphosate as a pre-harvest drying agent on oats.

Lowering by 300-fold the permissible level of glyphosate residues on oats, restoring the legally allowed level to just 0.1 parts per million, or ppm.

Requiring the Department of Agriculture to regularly test fruits, vegetables and other foods routinely fed to infants and children for glyphosate residues.

The most widely used pesticide in the U.S., glyphosate is mostly used as a weedkiller on genetically modified corn and soybeans. But it is also increasingly sprayed on oats and other grains just before harvest as a drying agent, or desiccant. Glyphosate kills the crop, drying it out uniformly so that it can be harvested sooner. This makes harvesting easier but also increases the likelihood that the pesticide makes it into foods.

Study examines how herbicide adds to phosphorus levels in soil and waterways

First commercialized by Monsanto under the name Roundup, glyphosate has come under scrutiny in the past, mostly in relation to its potential toxicity. This new research, published recently in the Ecological Society of America’s Frontiers in Ecology and the Environment, focuses not on direct health risks associated with the herbicide, but on its contribution to environmental phosphorus levels, an issue that has yet to receive much attention.

“No one has thus far investigated the impact of glyphosate use on phosphorus loads in agricultural areas, most likely because pesticides have always been considered a negligible source of nutrients,” says Marie-Pier Hébert, lead author of the study and a doctoral student in the Department of Biology at McGill University.

In many agricultural areas, decades of phosphorus-based fertilizer use have led to a saturation of the soil’s capacity to hold the nutrient. This increases the likelihood that any additional phosphorus applied to the land will run off into waterways, where it is a known cause of harmful algal blooms and deoxygenation leading to fish death.



“Our study argues that the recent and rapid rise in glyphosate use has magnified its relative importance as a source of anthropogenic phosphorus, especially in areas of intensive corn, soybean and cotton cultivation,” Hébert says.
