Former chief, treasurer charged in embezzlement from Monterey fire department

The Office of the State Comptroller will expand a probe at the Monterey Volunteer Fire Department to include the Schuyler County Sheriff’s Office after finding that the fire department’s treasurer and her husband, a former chief who is a county jail administrator, treated more than $100,000 of fire department money as their own.

Kimberley States, the fire department’s treasurer, and her husband, Schuyler County Sheriff’s Sgt. Larry States, a past fire chief, were charged by state police Friday in the theft, according to a statement from the state comptroller’s office.

“For more than five years, these officials were able to embezzle (fire) department funds to help pay for their home mortgage, cell phones, groceries, concert tickets, family vacations and a personal vehicle,” State Comptroller Thomas P. DiNapoli said in a statement about the investigation.

Kimberley States was charged with second-degree grand larceny, a class C felony, and Larry States was charged with third-degree grand larceny, a class D felony, according to state police.

Both were arraigned in Montour Falls Village Court and released. They are scheduled to appear Feb. 12 in Orange Town Court.

The comptroller’s audit began in August 2012 and is expected to be complete in the coming months, the comptroller’s office said.

Schuyler County Sheriff Bill Yessman said by e-mail Friday that Sgt. Larry States has been suspended, though he said he could not comment on personnel issues.

Yessman said States did not have access to any of the sheriff’s office funds, and that his office will fully cooperate with the comptroller’s office.

State: Monterey ‘negligent’ in oversight

MONTEREY—The New York State Comptroller’s Department released its report detailing how nearly $140,000 in funds were misappropriated from the Monterey Fire Company.

The audit covers Jan. 1, 2007, to March 14, 2013, right before it was released. It states that Larry States, fire chief, and then treasurer and chief’s wife, Kimberly States took nearly $140,000 from the department during the time audited. The report added the Monterey Fire Company should seek full reimbursements from the couple, as well as maintain better reviews of the finances.

The state said, “the (department) board and membership were negligent in the performance of their oversight of the company’s financial operations. All financial activities were performed solely by the treasurer, and the board did not implement compensating controls. This egregious lack of oversight created a weak control environment.”

The audit said Larry and Kimberly States were able to initiate non-company transactions without detection by making purchases with the company’s bank debit card and on the department’s credit with vendors. Additionally, Larry used the company’s accounts to make sales tax-exempt purchases for his contracting business—some of which he paid with the department’s debit card—and used fire funds to help purchase a personal vehicle.

Finally, the state added Kimberly deposited company revenues totaling $213 into her personal credit union account. These personal purchases, payments, cash withdrawals, and misappropriated revenues totaled $113,311. The state also identified another $26,386 in questionable payments and purchases that appeared to be personal in nature.

The report adds, Kimberly States gave the comptroller’s office a signed statement saying she had used the fire department’s money for personal use. On Jan. 11, 2013, the state police arrested both States and charged them with grand larceny.

The comptroller’s office added the couple reimbursed the fire department a combined total of $5,846 in late 2011 and early 2012. This leaves the total known misappropriated funds at an estimated $134,000.

The state recommended the department seek reimbursement for the $35,303 in improper payments to the couple’s family; the $9,530 in ATM withdrawals and related fees from the former treasurer; the deposit of $213 in company funds into personal credit union account; and the $68,265 in improper purchases by the States.

Grand Jury indicts Larry, Kimberly States

Larry States, 41, and his wife Kimberly, 46, were indicted Tuesday by a Schuyler County Grand Jury on charges of Grand Larceny and Falsifying Business Records, all felonies.

The charges stem from an investigation conducted by the New York State Comptroller’s Office and the New York State Police into the theft of more than $100,000 from the Monterey Volunteer Fire Department, where Larry States -- at the time employed as a sergeant in the Schuyler County Sheriff's Department -- served as Fire Chief. Kimberly States was the fire department treasurer.

Larry States, of 271 Owego Street, Montour Falls was indicted on one count of Grand Larceny in the Third Degree (a Class D felony), one count of Falsifying Business Records in the First Degree (a Class D felony), and one count of Tampering with Physical Evidence (a Class E felony).

The highest charges carry a maximum sentence of up to seven years in State prison. States will be arraigned by Schuyler County Judge Dennis Morris at a later date.

Kimberly States, of 910 Doane Road, Beaver Dams, was indicted on one count of Grand Larceny in the Second Degree (a Class C felony) and one count of Falsifying Business Records in the First Degree (a Class D felony).

The highest charge carries a maximum sentence of up to 15 years in State prison. She also will be arraigned by Judge Morris at a later date.

Schuyler County couple admit theft from fire department

A Schuyler County couple has admitted to stealing money over a six-year period from the Monterey Volunteer Fire Co. to buy items such as a sports car, jewelry, electronics and tickets to a Def Leppard concert.

Schuyler couple sentenced in theft from fire department

WATKINS GLEN — The former chief of the Monterey Volunteer Fire Co. and his wife were sentenced Thursday in Schuyler County Court for embezzling as much as $139,000 over a six-year period from the fire department.

Larry States, who is also a former sergeant at the Schuyler County Sheriff's Office, was sentenced to 1.3 years to four years in prison. His wife, Kimberly States, the former treasurer of the firefighters, received a one-year sentence to be served in a local jail.

The pair were indicted in June by a Schuyler County grand jury after the embezzlement of as much as $139,000 was revealed by an audit by the Office of the State Comptroller into the fire company's finances. The prosecution and defense attorneys later agreed that $115,000 in restitution was necessary. Of that, Larry States has already paid $10,000.

The couple admitted to taking money from fire department funds to buy items such as a sports car, jewelry and concert tickets. Both pleaded guilty to third-degree grand larceny, a felony.

Schuyler County Court Judge Dennis Morris noted that when Larry States pleaded guilty, the court made no agreement to be bound by the sentence of one to three years in prison as requested by Schuyler County Assistant District Attorney John Tunney.

Morris cited the "monumental" nature of the case, especially because States' employment with the sheriff's office meant the volunteer fire department had a heightened reason to trust him during the years he and Kimberly States stole from them.

"He's betrayed the citizens of this county and his fellow officers," Morris said before handing down the sentence.

Larry States' attorney, James Ferratella, asked the court for extra time for States, who had taken a job to earn money for restitution, "to get his affairs in order," noting that he hadn't expected imprisonment because a pre-sentencing investigation by the Department of Probation didn't recommend it.

Tunney objected, stating that the possibility of getting prison time Thursday should not have come as a surprise.

Morris denied Ferratella's request, and, a few minutes later, States was escorted away in handcuffs by officials including Schuyler County Undersheriff Breck Spaulding.
