So, I have a relative in the elementary building who is being bullied everyday by the cafe' staff and other students. when talking to the principal about the situation, we were told that the child doing the bullying, was actually doing so much better, that they did not want to do anything to cause a set back. They did not address the situation with the staff member. What are we supposed to do, they will not let us talk to the superintendant, and refuse to solve this.

I may be stepping in what you will find in a cow pasture. So here goes. If you know the Superintendants' name, he/she must have a phone. Call he/she. If that doesn't work go to the Police and make out a Bulling report. I am quite sure you will get someones attention. If that doesn't work, go right up the food chain till you get some answers.

Agreed. At the office or at a board meeting.

We called the supers' office and they patched us to "voice mail" we have not recieved a return phone call. The police department also said we had to go to the school and start there, which we did and told them so, we called nozollio's office, he too forwared us back to the school...almost to the point of dispair here.....I supposed we could show up and just wait for someone in the supers' office to notice were still looking for a solution, but why do we have to put up with this?????
I know it happens in all schools...just wish when it is brought to someones attention, that they do something to stop it!!

Keep calling the Super's Office and leave a message everyday. They will get sick of it and call you back. This bully stuff goes on in all of the schools. Even the one(Jr High) where they won an award for no bulling It just depends who you are!

Call again and specify that you do NOT wish to be shuffled off to VM and if the super can't speak with you at that moment ask WHEN he will be available to speak with you...you can even make an appointment to see him. Your job is to be persistent in your pursuit of a solution and I would keep knocking on that door until you get results. It does you no good to ask why you "have to put up with this" until you solve the more immediate problem of bullying. After that has been satisfactorily addressed THEN you begin to work on the why...preferably with a potential solution such as a resource at the school to address the issue and a documented procedure for both a child and the parents of the child to follow...and if that procedure breaks down...fall back procedures.

In other words, it is up to YOU to advocate for your child/relative until a permanent solution is reached.

This has been shown in the news a few times recently: wire your kid and post it on you tube and send the recording to everyone.

Years ago when I wanted to talk to the super,I simplely stated that I would hold him directly responsible and that I would sue him if I did not get a return call. Win or lose it would cost him.

Then I would not answer the phone the first 5 or 6 times he called.

Call the superintendents office and inform them you are going down to file a complaint at the police station, then do it, irregardless of if he suddenly jumps on the line. Be sure to name the principal who refused to take action against the staff or student in your complaint.

Looks like you need to make it a bigger headache to deal with you instead of dealing with the bully's parents.

You go to the office and wait ... he has to leave sometime and there is no brushing you off that way!

You could always mention calling a few news stations, that may get someones attention

Syracuse channel 9 or Rochester channel 13 like to investigate problems like this. Publicity works wonders.

The State of NY has passed a law known as “TheDignity for All Students Act” that will take effect July 1 2012. This amends laws already inplace concerning abuse, bullying and codes of conduct. While this new amendment may not apply today, it will after July 1st. You will note there are penalties for schools and staff, (loss of federal and state funds etc.) that do nothing concerning incidents of bullying.

If it were me I would question my child closely and document the date, time, who was there when the bullying occurred and what was said. After arming myself with this information I would note who I contacted in reference to the bullying or abuse, everyone from the lowest to the highest in authority and ask for their name, noting the date, time and nature of contact, what if any action was taken or not taken. I would let them know I was keeping such a record as often that will spur a red tape artist to be more helpful. When calling ask for their name first, then state your request. Keep this record or journal to prove your complaint if no action is taken.

Here are a few resources to review and note the contact points for the Caps program.

If I had a kid being bullied there would be no end to the lengths I would go to make sure something was done. I would follow the ladder to the highest chain of command and make threats if necessary and I would call the cops and tell them just what I said and tell them they better do something about it or I WILL! bottom line end of story-
