Breaking News : Seneca County Woman Indicted for Allegedly Stealing Money from Childrens Committee

Seneca County District Attorney Barry Porsch this afternoon announced that a five-count indictment has been filed charging Mary A. Brainard of Route 89, Romulus, NY, with Grand Larceny in the Third Degree (class D felony) and four counts of Falsifying Business Records in the First Degree (class E felony). The maximum possible sentence for the class D felony offense is 7 years.

The indictment alleges that between April 2010 and December 2011, Brainard stole money from the Seneca County Children’s Committee and that on four occasions she submitted a false financial report to the Committee in order to conceal her commission of the larceny. The indictment resulted from an investigation conducted by the New York State Police.

Brainard and her husband Calvin are facing federal charges for allegedly being involved in mail fraud and conspiracy to commit bank fraud. The U.S. Attorney's Office accuses the mortgage firm owners of taking money from a client in 2009 . The Brainards represented the client in refinancing a mortgage and pocketed over 95-thousand dollars instead of paying the clients mortgage.

yeah. i told everyone months ago when the first charges came out there would be more. i've dealt with these people and they almost got us.

Just another example of 2 worthless thieves. If they put as much time and effort into legitimate work, as they did in ripping people off they probably would have made money without having to face prison time. Lets hope they get convicted, locked up and then throw away the key.

Are you saying that Barry might be afraid to go to trial against a "lawyer couple" who would perhaps know just which lawyer(s) to hire?

Maybe, but as long as they get no softer treatment, by pleading, than anyone else would get, I'll be happy, as long as they get something reasonably stiff. If stuff this bad, involving lawyers, keeps happening, and particularly if they get a slap on the hands,lawyers will get an even worse reputation, if you can imagine that. Some of them deserve it; although they are no worse than any other occupational class, they do have a lot of opportunity, and the same greed that other people have.

If they get a mere slap, then Porsch's rep will slide another notch, too.

I'll bet that the man who should be DA is watching with interest...

It is not a couple here - just Mary and the Grand Jury had to see evidence that they felt was enough to confict. She's not getting out of this one

I'm aware of that. By "lawyer couple", I meant that the couple that she is part of has a lawyer in it, and that he would presumably be advising her in her defense, and would presumably know which lawyer to hire.

I was also tangentially referring to these separate charges:

Grand juries often are steered and manipulated by the prosecution, to the extent that they will often "indict a ham sandwich" if that's what the prosecution is able to convince them is the right thing to do. In this case, though, I think you're probably right, in that it's the type of case where there is a a trail that is easy to follow. We'll just have to see what the jury thinks, if it goes that far.

Had they not put themselves in a situation that would put them in the media spotlight then these comments would not exist. They brought them on themselves. If you don't like it stop looking at the forum. I do not see any reason for this to be locked other than as a personal favor. I hope that justice will be served on them rather than being downplayed because they appeared to bear upstanding citizens. Disgusting what they did. They deserve jail time.

It could be a friend of the Brainards, and/or someone who has employed one of them in a separate legal matter. And DD has weighed in on other topics, after all.

We've used Mr. Brainard as our attorney on a very difficult case and won, he was profesional and answered all our questions and concerns in a timely fashion, professional at all times. I like the man, and hope that the charges against him are untrue.
