There sounded to be a bad car accident on 414 this evening. I was at my friends listening to the scanner and they had mercy flight standing by and called the jaws of life. Hope they are ok.

Hey oops it was a woman and 2 children , a rollover, kids had some facial lacerations and woman was trapped with a chest injury. Kids were ok then didn't hear anymore after jaws of life were called for. I too hope everyone will be ok.

They don't plow their own roads either. Why would they when they can mooch off a tax supported system to provide road maintenance, fire and police services for them.

That's exactly what my husband and I were wondering?
Could they really sue and on what grounds? After all it's the taxes that pay for the service and if u don't pay taxes it seems u aren't entitled to the service.

As much as I would love to see that happen, I don't think it would. After all, the fire dept responds to any vehicle fire. They don't see if you are a resident that pays taxes first.

That's a good point too. I take it that the gas station doesn't pay local property taxes in addition to sales tax to the state?

They probably are paying taxes on both Lakeside properties because they are trying to get those properties taken into trust. In order to have them taken into trust the property taxes must be current.

Well I guess that means they have to respond , but I guess a slow response could be considered helpful at some point.

The fact that you think an intentional slow response to a fire, under any circumstances, is acceptable speaks volumes.

My opinion is absolutely. Just as they would if a property's taxes were delinquent. Just as they would if a property was exempt from property taxes (i.e. a church). Certainly I have not talked to EVERY firefighter but the ones I have always say they feel it is their responsibility to respond to fires. A responsibility they take seriously, thankfully for the rest of us.

Just a thought, if all property were exempt who would pay for the equipment the firemen used when they responded?

Thank you's, do not buy a fire truck, boots, turn out gear, maintain hydrants, a pressurized water suppply plus fund the other costs, they are supported through taxation of property within a given fire district.

Comparing a church exemption to the Cayuga situation? Mmmmmmmm.

Slow response, never, should not happen.

However if they do respond to fires on tax exempt propeties who do not pay taxes then a BILL should follow covering the expense for the turnout.

Most have property and fire insurance which is rated for community response from a tax supported fire department. Let the premiums for such policies reflect they will have to pay for fire fighting as part of their policy as they are tax exempt. That is virtually how fire insurance companies began in the first place. The premiums supported a fire company who would respond to those properties that were insured.

This already happens with Canada and Mexico. And, if memory serves, there were firefighters from Mexico at the WTC after 9/11.

I'm willing to bet that if you go to some of the larger reservations out west (and a few here in the east) that you will find reciprocating agreements between the reservation and the surrounding communities about fire protection. My dad lives about 5 miles from the Pequot reservation (and casino) in CT, and they have a very nice firehouse there. I'm willing to bet that there are agreements in place with Stonington.

The Casino, multi-story hotel and reservation five miles from Oldbroad in Cabazon, CA has their own fire dept with a nice new fire trunck capable of fighting high rise fires. They have their own security and police force. They are good neigbors to the community making many charitable donations of food and money through out the year. They also collect and remit sales taxes at their gas station/convenience store. If you don't have a tribal ID card you must pay taxes on all purchase. Those are the true facts of how they prove they are good neighbors.

Do you know if they have a reciprocating agreement with other communities in their area regarding firefighting?

I like the fact that they remit sales tax, and require their members to present ID cards for non-tax. It would be nice if the Cayugas were like that...

I am not sure what agreements they have. I do know that OB has said that the local fire dept and police can not enter the reservation without permission. If I remember correctly the reservation fire dept. has helped fight wild fires in the area.

I also know they give Turkeys and all the things that go with a Thanksgiving dinner to the local Moose Club for a free community Thanksgiving dinner. The Moose members cook and serve the Turkey dinners to anyone that comes through the door free of charge.

No problem with taxes at their businesses. No tribal ID you pay tax no exceptions.

I'm going to guess that if the Cayugas operated like this, they would have far fewer problems with their neighbors. I'm also guessing that the Cayugas insist upon a tax free status because they have no casino... or at least not one that would rival Turning Stone. Tax free cigs and gas is therefore their mainstay.

Sad part is they could probably collect the sales tax on their own brands and still be cheaper than other places that sell brand name cigarettes and still have an advantage.

The cayuga sold their reservation many moons ago. all NYS/county laws apply. Considering that the cayuga remove around $30 million a year out of the community that they could provide their own fire protection. Lets see if they explain to the judge why they rely on the county but refuse to pay their share of the sales taxes.

They tried a bingo hall but the county closed it

the taxes are not paid on the other properties and neither are the sales taxes

The first idea, of course, is to find yourself a lawyer and at least get some legal advice about the problem. See if you can find one that specializes in environmental law.

Other than that, approach the prosecutor and explain that you truly didn't understand the law. There is a slight chance that he/she will have mercy on you.
