Dalton withdraws from Sheriff’s Race

Citing complications with the Federal Hatch Act, Palmyra Police Chief Dave Dalton withdrew from the Wayne County Sheriff’s Race tonight.

The announcement came at the Macedon, Palmyra, Walworth Chamber of Commerce meeting featuring the three candidates at a meet and greet.

On Friday, candidate Barry Virts, Chief Deputy/Chief Administrator of the Wayne County Jail for the Sheriff’s Office announced he would resign his position effective October 28th in order to continue his run for sheriff. He too received a ruling concerning the Hatch Act. The U.S. Office of Special Counsel, the federal government entity responsible for rulings concerning the Hatch Act determined the Wayne County Jail received payment for federal prisoners housed at the County facility, therefore putting Virts in violation the Hatch Act.

Dalton received a letter from the U.S. Office of Special Counsel stating because his department received some federal monies in grants, he too would have to either resign from office, or pull out of the race.

Dalton had made it clear on Monday that if a ruling by the Hatch Act determined he would have to make a choice, he would not resign as police chief of Palmyra.

So, this means that anyone who is employed by an entitiy that receives federal funds cannot keep his/her job while running for public office?!

Doesn't that pretty much knock out many of the current Wayne County candidates! Why then has the US Office of Special Counsel not imposed the Hatch Act ruling on all our local town and county government candidates? Don't they all receive some form of federal funds?

Ridiculous! Sounds like a hostile enforcement of an old law for the convenience and advantage of someone.

sounds like you have been the recipient of some of Chief Dalton's policing over the years. tell us how you really feel about Chief Dalton!!!

Best wishes to Barry Virts and his family. Attended "Investigators" school with Barry many years ago. also know Chief Dalton who is very dedicated to his job.
