Odessa, August 28:
The Tim Jaynes hearing at the Odessa Municipal Building concluded at about dinnertime Friday with hearing officer Robert Halpin reserving his decision until he has a chance to sift through the evidence.
Jaynes is the Odessa Department of Public Works superintendent who was removed from his job by the Village Board for various alleged transgressions:
- -- letting someone use his village cell phone, in violation of village policy (although Jaynes said he was merely being polite to someone calling in a complaint to the village);
-- helping pull someone's car off a grassy slope near the Odessa House (though he never got to actually pull it, since the vehicle climbed clear under its own steam);
-- slamming a door at the clerk's office (though he said he merely "flipped" it shut);
-- declining to provide the Village Board with mileage logs (though he did, he said, after he figured out what exactly the board wanted in the absence of any prescribed forms);
-- purchasing tires for a village truck without prior approval (though he says it was a safety move to protect the driver, a village employee who was having trouble controlling the vehicle in deep snow on the old tires);
-- telling a village trustee that "you should keep your nose out of this" during a discussion of guardrail work (but he says he apologized afterward);
-- starting a street striping project without board approval (though he says he gave the board an estimate of $400 and thought it was budgeted, and only did preliminary work that cost the village nothing);
-- refusing to help in setting up a school-parade route with fire department assistance (though he said that the traditional DPW role had been made difficult the previous year by a fire department representative who tried to boss him around "when I was the one in charge");
-- failing to follow a directive to place sandbags along the property of a resident beset by water woes (although the resident didn't want the sandbags, considering them a typically temporary village measure, and told Jaynes to "put them where the sun doesn't shine");
-- verbally accosting the son of a village couple with whom Jaynes had had run-ins regarding plowing (although he said he merely gave the boy "helpful hints" while the boy was shoveling the family driveway);
-- ordering the County Highway Department to deliver salt to Odessa (although testimony showed that the person he spoke to later said "it wasn't so much a demand, as it was Jaynes' personality");
-- mowing with the flap up on the side of the village mower after being told not to do so (although he said he followed orders except when mowing near such fixed items as posts, which would have flipped the flap up);
-- and claiming two hours of overtime without prior authorization (although he said it was undertaken to help restore water to a residence along Route 228, a chore possibly within the realm of permissible overtime, although that was not clearly established).
a large part of what this is about: whether Jaynes exceeded the boundaries of his job.
The ball is now in Halpin's court, so to speak. When he reaches a decision, he will make a recommendation to the board either backing its decision or opposing it.

Odessa, September 4 Legal problems continue for Tim Jaynes, the Odessa Department of Public Works superintendent who was removed from his job by the Village Board last month. New allegations were released today as part of the continuing investigation. They include: -- Leaving the toilet seat up in the bathroom of the Odessa Municipal Building on at least 3 occasions in 2008 and purposely replacing the toilet paper roll "under" instead of "over" as required by Village policy. -- Illegally removing the tag from a chair cushion. -- Parking a Village vehicle for 16 minutes in a "15 Minute Parking" parking spot. -- Mowed Village property in a clockwise direction after being told to mow counterclockwise on several occasions by Board members.

Odessa Board votes to dismiss Jaynes
ODESSA, Oct. 6 -- The Odessa Village Board voted Monday night to terminate the employment of Tim Jaynes as the Superintendent of Public Works.
The move came following an executive session that lasted more than a half-hour. The vote was taken in front of 14 village residents on hand to view the proceedings. The only dissenting vote came from board member Rita Decker.
The decision, effective immediately, comes two-and-a-half months after Jaynes was suspended for what the board said were multiple job offenses. Jaynes took the matter to a hearing, which was held in two parts in mid-August and late August. After that, Jaynes and village officials waited for a decision from hearing officer Robert Halpin.
Halpin's ruling, released late last week, said that nine of 27 charges against Jaynes had been proven, but did not seem substantial enough to warrant dismissal. He said they did warrant further disciplinary action, and suggested that if the board were to proceed with a vote to terminate, then case law indicated Jaynes would not be able to overturn the decision on appeal in the courts.

Sounds like this Jaynes guy pi__ed someone off. I don't live anywhere near Odessa or Schuyler County, but I would think they could come up with a more legitimate reason to fire a guy. Sounds like someone doesn't like his personality. It's too bad people can't get along, and it's also too bad that people on the board think they are better than anyone else and pick up on petty s__t to complain about.

Yup, pretty petty stuff but still stuff and a good lesson to those in the Public crosshairs you have to be careful but sounds like someone had it for him and wasn't going to be denied.
