Brockman enters DA race

Another area attorney has announced plans to run for election to the Yates County District Attorney’s seat.

Edward J. Brockman, who has been practicing law in Yates County for over 30 years, announced his plans last week to seek the seat currently held by Susan Lindenmuth.

“I’ve always wanted to do that job and I believe that I have the ability,” said Brockman, explaining he previously considered running for district attorney in 2001, when Lindenmuth planned to retire, but then changed her mind.

“Now is the time to do it,” he said.

Brockman and his volunteers, in addition to other candidates for several offices in Yates County, began circulating petitions Tuesday, June 9. He will face First Assistant District Attorney Jason Cook in a Republican Primary in September.

The Yates County Republican Committee has said it will not endorse a DA candidate until after the primary.

“I supported that,” says Brockman, adding, “It’s my opinion that the voters should make that decision rather than the county committee.”

Brockman has been a Yates County Public Defender for 15 years and has served as attorney for the Village of Penn Yan for six years, the Town of Italy for 32 years, the Town of Naples for 30 years and the Town of Potter for 15 years.

He also has worked with other area municipalities over the years, and says the combined experience from the public defender’s office and from the municipal work, prepares him for the district attorney’s office.

“Legal training prepares you for both sides of a case,” he says, adding that he has prosecuted numerous code violations in his municipal work.

“Having been public defender has given me more perspective,” he says, explaining that in dealing with cases of fraud, he can see how devastating the situation can be for a municipality and for an organization.

With that in mind, Brockman says if elected, he would like to expand the functions of the DA’s office to include an attempt to diminish crimes involving the misappropriation of funds in not-for-profit organizations.

He says he would develop a program to go into the community to talk to organizations about how their funds should be handled to avoid having money taken by the individuals who are supposed to be responsible for the safe-keeping of the assets.

While he also has some other ideas for educational efforts to expand community awareness and crime prevention programs, he says there aren’t many changes he’d make to the office’s operations.

“It’s my opinion that the district attorney’s office has been professionally run under the administration of Susan Lindenmuth. Obviously, I would not change anything that I feel is handled appropriately,” he explains.

Brockman, whose family owned a farm in Irondequoit, moved to the Town of Italy in 1975. “I moved here because I love the area,” he says.

He and his wife, Lori, have five children. He has been a member of Rotary for 25 years, and he has been active as a Boy Scout Troop leader in the past.

The Yates County District Attorney’s office has grown since 2001, when the DA’s position was made full time. Since then both assistant DA positions have been expanded to full time positions as well.

The only reason I'd like to see Brockman as the DA is to see a capable public defender go up against him!!!

ohhh he's always wanted to do the job... That's nice...

He wanted to run 2001 but backed down after he heard Lindenmuth changed her plans and was not retiring. So my question is if he's always wanted to do the job why back down in running? Did he not think he could beat Lindenmuth in an election but now can beat her protege? Or does he believe someone should hold a term until they retire??? It has to be one of the two.

not too sure on brockman but have been told that Jason Cook does have that "bulldog" character and desire to seek justice that a DA needs

I am interested in seeing Brockmans response to the fact that a curfew like we have in PY has been deem unconstitutional. This guy has been wearing too many hats for too long and this one is going to be ugly for him... ...as I said in the curfew being unconstitutional thread, I wonder what hat Brockman will wear? Will he wear a hat as a public defender and petition the court to vacate convictions of his clients (as public defender) of youths lets say charged with possession because the search came because of a violation of curfew, which has been deemed unconstitutional? Or will Brockman wear his hat as the Penn Yan Village attorney and not bring any motion as public defender to protect his client, the Village, from being sued for violating his other clients constitutional rights.

There is your conflict of interest right there, we have played what if with scenarios and now we see a big UH OH... This should be interesting to watch.

Which is why it is very important for Cook and Brockman to debate in a public forum! It is only fair to the voters.

I really don't know whats the difference... Have you seen him in action? Wearing his hat as public Defender, he acts like he's part of the DA's office.

I really hope someone else decides top run!!! I am NOT voting for Brockman and I am not voting for anyone who is/was part of Lindenmouth's office!!! Can I write in Dan Fielding from Night Court?

Actually King, don't condemn Cook just because he works there now. Jason is a very different person than Lindenmuth. He is an asset to that office and will make an excellent DA.

Perhaps now that his wife is the Republican Party Chairman is why?
